Trying to change how your counterpart's hobbies, their opinions, their political alignment, etc., cannot be justified in today’s world. Such infringement of personal space could become a point of argument and lead to the relationship's downfall.

The Hon'ble Supreme Court explicitly recognized live-in relationships for the first time in 2006, in a case titled Lata Singh v. State of Uttar Pradesh, when it ruled that an adult woman was "free to marry or live with whomever she chooses."

However, the Hon'ble Supreme Court further stated in S. Khushboo v. Kanniammal (2010) stated that morality and criminality could not coexist. The relevant observations are worth reproducing herein in full:
"While there can be no doubt that in India, marriage is an important social institution, we must also keep our minds open to the fact that there are certain individuals or groups who do not hold the same view. To be sure, there are some indigenous groups within our country wherein s*xual relations outside the marital setting are accepted as a normal occurrence. Even in the societal mainstream, there are a significant number of people who see nothing wrong in engaging in premarital s*x. Notions of social morality are inherently subjective and the criminal law cannot be used as a means to unduly interfere with the domain of personal autonomy”

How mental cruelty can be a ground for divorce?

The Hindu Marriage Act,1955 did not have ‘cruelty’ as a ground for seeking divorce. It was only after an amendment in the year 1976 that this ground became available for seeking both divorce and judicial separation.

Though, Parliament did insert the term ‘cruelty’ in the Act, but it is not an exhaustive definition resulting, the term has since been understood according to its interpretation by the judiciary over the years and according reliefs are granted in cases of both physical and mental cruelty

Supreme Court has in the matter of Rajnesh vs. Neha & Anr. Criminal Appeal No. 730 of 2020 arising out of SLP (Cri) No. 9503 of 2018 has inter alia, framed guidelines on aspects pertaining to payment of maintenance in matrimonial disputes including issues of overlapping jurisdiction, Payment of Interim Maintenance, Criteria for determining the quantum of maintenance, Date from which maintenance is to be awarded, Enforcement/ Ex*****on of orders of maintenance and the framing of Affidavit of Disclosure.

The issuance of the aforesaid Guidelines by the Hon'ble Supreme Court will streamline the entire process of granting maintenance to a spouse
