The rule of bail is now considerably changed.
In the case of Satender Kumar Antil Vs CBI, The Hon'ble Supreme court of India has ruled that there shall be 4 categories ABC &D of the cases which are brought in court for bail. The cases under which there is punishment up to seven years, there should be approach that the bail is rule and the jail is exception. But grievous offences have to be decided on its own merit.

ब्यवहार न्यायालय में मना सम्बिधान दिवस।मेदिनीनगर,जिला विधिक सेवा प्राधिकार के तत्वावधान में शनिवार को संविधान दिवस के अवसर पर ब्यवहार न्यायालय परिसर में प्रस्तावना का पाठ पलामू के प्रभारी प्रधान जिला व सत्र न्यायाधीश संतोष कुमार की अध्यक्षता में किया गया। उन्होंने सभी न्यायिक पदाधिकारी, अधिवक्ता ,न्यायालय कर्मी को संविधान के प्रस्तावना का शपथ दिलाया।मूल कर्तब्य, मूल अधिकार, मौलिक कर्तब्य व लोकतंत्र के बारे में बताया।इस मौके पर डीजे प्रेम नाथ पांडे, अभिमन्यु कुमार ,अमरेश कुमार, सी जे एम निरुपम कुमार,संजय सिंह यादव, आनन्दा सिंह, एस डी जे एम अमित गुप्ता, जिला विधिक सेवा प्राधिकार के सचिव अर्पित श्रीवास्तव, शिखा अग्रवाल,निशिकांत,संदीप निशित बारा, परमानंद उपाध्याय, सतीश कुमार मुंडा, मनोज कुमार, मिस रूबी, मिस अपेक्षा, अमित बंसल, प्रतीक राज, अधिवक्ता संतोष कुमार पांडे, संजीव सिंह, समेत दर्जनों लोग उपस्थित थे।

FILING OF COMPLAINT IN COURT FOR A COGNIZABLE OFFENCE
Section 2(d) of the code of criminal procedure (hereinafter shall be indicated as 'the code') defines the term complaint which is quoted hereunder:
2(d) " complaint" means any allegation made orally or in writing to a Magistrate, with a view to his taking action under this Code, that some person, whether known or unknown, has committed an offence, but does not include a police report. Explanation.- A report made by a police officer in a case which discloses, after investigation, the commission of a non- cognizable offence shall be deemed to be a complaint; and the police officer by whom such report is made shall be deemed to be the complainant;
It goes to show that a complaint can be filed either orally or in writing before the chief judicial magistrate/judicial magistrate or the Chief Metropolitan Magistrate/Metropolitan Magistrate as the case may be having jurisdiction to take cognizance if the offence is cognizable in nature. If a police officer after investigation submits a report regarding the non cognizable offence, it also shall be treated as the complaint.
Chapter XV deals with the procedure taken by the concerned Magistrate when complaint is filed which is quoted as below:

A Magistrate taking cognizance of an offence on complaint shall examine upon oath the complainant and the witnesses present, if any, and the substance of such examination shall be reduced to writing and shall be signed by the complainant and the witnesses, and also by the Magistrate: Provided that, when the complaint is made in writing, the Magistrate need not examine the complainant and the witnesses-
(a) if a public servant acting or- purporting to act in the discharge of his official duties or a Court has made the complaint; or
(b) if the Magistrate makes over the case for inquiry or trial to another Magistrate under section 192: Provided further that if the Magistrate makes over the case to another Magistrate under section 192 after examining the complainant and the witnesses, the latter Magistrate need not re- examine them.
It goes to show that when such complaint is filed, the concerned magistrate shall either send it to the police station for investigation and report without taking cognizance u/s 156 of the code, or may take cognizance of the offence and examine the complainant and his witnesses if any and proceed further as per Chapter XVI of the code or may reject the complaint under section 203 of the code. It further provides that if such complaint is filed by the public servant with regards to the offence committed while acting as a public servant or it is sent under section 192 of the code to the another magistrate, the said magistrate is not required to examine the complainant on oath or his witnesses. It further provides that even if the former magistrate does so, the later magistrate is not required to re -examine them.
In the Indian justice dispensation system there are two types of cases in court one is based on police report and other is based otherwise than on police report. In police report cases are to be instituted and tried on the basis of investigation report but the complaint cases are to be tried on the basis of the inquiry made by the Magistrate. All the non cognizable cases even are instituted on the police report after investigation are treated to be a complaint and the investigating officer as the complainant.
