Rakesh Kumar Mallick Adv: Jay Jagannath If an advocate surrender his license then he will get in lakhs as per his practice for which if any advocate needs interim payment then the OSBC should have allowed upto 50% of present surrender value which can be adjusted at the time of surrender or death benefit. Such interim payment is neither begging nor donation rather from his retirement cm death benefit, which will not be hindrance to anybody and it will be helpful to needy lawyers, I urged to aurhority to consider it and release interim payment whoever will apply for it without any condition... Alongwith his scan of licence and first page of bank passbook, It is not about surrender rather stated if surrender then the present value will be determined and without surrendering if he sought for interim relief upto 50 % of present surrender value not that 50% it may be 10% or 20%or 30% or 40% or 50 % as per his application, there is no need of surrender, only for calculations the term Surrender used. If an advocate did not apply for interim benefit then he will get full death cm retirement benefit of Rs 9 lakhs as usual. Only OSBC death cm retirement benefit trust has to calculate and update the reimbursement amount to granted advocate, only clerical work enhanced and state government may contribute two to three crores in the trust as Delhi government contributed.
