The Trade Mark Rules, 2017 have been notified and have come into effect from 06th March, 2017. These Rules, which replace the erstwhile Trade Mark Rules 2002, will streamline and simplify the processing of Trade Mark applications.
Some salient features of the revamped Rules are as follows:
 Number of Trade Mark (TM) Forms have been reduced from 74 to 8.
 Fee for online filing has been kept at 10% lower than that for physical filing.
 The fees for Individuals, Start-ups and Small Enterprises have been reduced from that proposed in the draft Rules – i.e. only Rs 4,500 as against Rs 8,000 for e-filing of TM applications proposed at the draft stage.
 Over all fees have been rationalized by reducing the number of entries in Schedule I from 88 to just 23.
 E-mail has been made an essential part of address for service.
 Hearing through video conferencing has been introduced.
 Numbers of adjournment in opposition proceedings has been restricted to a maximum of two by each party, which will help dispose off matters in time.
 Procedures relating to registration as Registered User of trademarks have also been simplified.
 Examination time for a TM application has already been brought down from 13 months to just 1 month in January 2017.

Smart Phone Patent Wars - Nokia Vs Apple

Nokia Corp said that it had filed a number of lawsuits against Apple Inc for violating 32 technology patents, striking back at the iPhone maker's legal action targeting the one-time cell phone industry leader a day earlier.

The legal action by Nokia and Apple appear to mark a revival of the "Smartphone patent wars" that began five years ago, when Apple filed a series of patent infringement cases against Samsung Electronics around the world, with wins and losses on both sides.

Startup Intellectual Property Protection (SIPP)

Startup India supports for fast-track examination of patent applications and rebate in fees.

Intellectual Property Rights (IPR) are emerging as a strategic business tool for any business organization to enhance industrial competitiveness. Startups with limited resources and manpower,
can sustain in this highly competitive world only through continuous growth and development oriented innovations; for this, it is equally crucial that they protect their IPRs. The scheme for Startup Intellectual Property Protection (SIPP) shall facilitate filing of Patents, Trademarks and Designs by innovative
Startups. Various measures being taken in this regard include:

• Fast-tracking of Startup patent applications: The valuation of any innovation goes up immensely, once it gets the protective cover of a patent. To this end, the patent application of Startups shall be fast-tracked for examination and disposal, so that they can realize the value of their IPRs at the earliest possible.

• Panel of facilitators to assist in filing of IP applications: For effective implementation of the scheme, a panel of “facilitators” shall be empanelled by the Controller General of Patents, Designs and Trademarks (CGPDTM), who shall also regulate their conduct and functions. Facilitators will be responsible for providing general advisory on different IPRs as also information on protecting and promoting IPRs in other countries. They shall also provide assistance in filing and disposal of the IP applications related to patents, trademarks and designs under relevant Acts, including appearing on behalf of Startups at hearings and contesting opposition, if any, by other parties, till final disposal of the IPR application.

• Government to bear facilitation cost: Under this scheme, the Central Government shall bear the entire fees of the facilitators for any number of patents, trademarks or designs that a Startup may file, and the Startups shall bear the cost of only the statutory fees payable.

• Rebate on filing of application: Startups shall be provided an 80% rebate in filing of patents vis-a-vis other companies. This will help them pare costs in the crucial formative years. The scheme is being launched initially on a pilot basis for 1 year; based on the experience gained, further steps shall be taken.
