The Supreme Court has reiterated an important principle of family law: when a child is born during a valid marriage, the law raises a strong presumption of legitimacy. In simple terms, if the husband and wife had access to each other during the relevant time, the husband is treated in law as the father. This presumption cannot be displaced merely by alleging that the wife had a relationship with another man. It can be rebutted only in limited circumstances by proving non-access.
๐ This ruling is a reminder that family law does not deal only with biology. It also protects the childโs dignity, legal status, and social identity. The Court also cautioned that DNA testing is not automatic and that privacy and dignity must be respected while dealing with such sensitive disputes.
