The has rightly held that criteria for any appointment in service should be based on the person’s qualifications and eligibility rather than age, as one who is younger in age can have more extensive knowledge on the subject if he/she has gained special on it, rather a person who is just appointed on the basis of his age. Knowledge of a person on the subject is more important than his age factor.

Justice Delayed is Justice Denied: Section 138 NI Act

Speedy trial is a Fundamental right as envisaged under Art. 21 of the Constitution of India which grants a person a right to speedy disposal of his case. Time and again Supreme Court has reiterated the need of speedy trial and its importance in the justice delivery system. Recently Apex Court has provided guidelines so that there can be speedy disposal of the backlog in cheque bounce cases under Section 138 of Negotiable Instrument Act

India being the second populous country of the world is in dire need of laws possessing stringent provisions to overcome the threat of overpopulation. This is a step towards a more efficient and self-reliant Bharat. In the past there had been numerous population control schemes and programs, essentially an initiative of the executive function, promising high hopes but actually were ineffective on ground level. This time the legislative route through an enactment by UP Govt. seems to be a solid determination in order to over come past failures. Population control through legislative enactments is imperative for sustaining the economy. Further, such laws are also necessary to make India a developed country from a developing one.

Why should Judiciary and Police officials have all the fun?

After providing all the perks to the important personalities of the legal system, now it is the time to provide the perks deserved by another important segment of law i.e., the Advocates. This move of the BCI will be praised and supported by all the advocates as this will allow them to work at their best without any fear from the outside world and will help them in the time of financial crisis. It is strongly hoped that the bill will become a reality in form of an enactment very soon.

The concept of reservation was evolved by the constitution makers to provide equality to the backward classes as envisaged in Art. 14, furthermore these reservation policies were framed for a small time period however even after 70 years of Independence they are still intact, and have now began to be a tool in the hands of politicians to fill their vote banks. The need of the hour is to review these policies and update them as they are still based on the situations which were prevalent 70 years ago, whilst fixing some rigid criteria for framing these policies. Euthanasia is the practice of intentionally ending a life to relieve pain and suffering. Different countries have different euthanasia laws. Euthanasia is categorized in different ways, which include voluntary, non-voluntary, or involuntary:

Voluntary euthanasia is legal in some countries.

Non-voluntary euthanasia (patient’s consent unavailable) is illegal in all countries.

Involuntary euthanasia (without asking consent or against the patient’s will) is also illegal in all countries and is usually considered murder.

One argument against legalization of active euthanasia could be the fact that this can lead to intended murders and then being proven as active euthanasia for personal benefits. We know that like everyone has different thought process, they have different ways to putting themselves in a state of mind where they feel active euthanasia to be an easier option. According to Hindu religion, the person who commits su***de neither goes to heaven nor hell, instead their soul roams around the earth as a bad spirit to complete the appointed lifespan. So, legalization of such actions can only be discussed after taking into consideration views of every religion on the topic and not just by the law. Since India is the biggest example of secularism and diversity, we can very well imagine how views related to topics like PAS, passive and active euthanasia may vary from person to person.

Is ODR really going to be the new normal?
The Internet has changed business, education, government, health care, and even the way in which we interact with our loved ones. While there is no doubt in the fact that the building Internet that is the building of the “World Wide Web” was a revolution bigger than expected, can we really think of the Internet playing a role or in fact the lead role in something as serious as the matters involving lawsuits?
