*CUSTODY OF MINOR & HABEAS CORPUS*

The Allahabad High Court in a recent judgment delivered in a Habeas corpus writ filed before it observed that if a mother enters into a new relationship without obtaining divorce from her husband, it will not deprive her of the right to obtain custody of her minor child, though her act may be looked down upon by the law and society.

The single bench of Justice J.J. Munir observed that " depriving the minor of his mother's company might have an adverse impact on his overall development. This, in-turn would derogate from minor's welfare."

A Habeas Corpus writ petition was filed by the father in the name of his son complaining that he is in the unlawful custody of his mother. The mother left her matrimonial home in 2019 and an FIR was lodged by her husband under Section 346 I.P.C . The wife's statement was recorded under 161 Cr.P.C and thereafter under Section 164 Cr.P.C wherin she stated that she had married someone else and produced a marriage certificate to that effect.

The petitioner however alleged that since she married without obtaining divorce , her second marriage is a nullity and she has lost her right to her son's custody.

The Hon'ble Court observed that the welfare of the child is of paramount consideration . The minor is of tender age of 5 years and he needs care which only mother can provide. The father was engage in earning his livelihood and there is no one at home to take care of the child.

The father was granted visitation rights.

On this day (31st July 1940) exactly 80 years ago, Sardar Udham Singh sacrificed his life for the freedom of our country. He died so that we may live with freedom and dignity. His sacrifice will continue to inspire the coming generations. Shaheed Udham Singh amar rahay.

New Education Policy 2020 is announced:-

1. 10+2 board structure is dropped
2. New school structure will be 5+3+3+4
3. Upto 5 pre school, 6 to 8 Mid School, 8 to 11 High School , 12 onwards Graduation
4. Any Degree will be 4 years
5. 6th std onwards vocational courses available
6. From 8th to 11 students can choose subjects
7. All graduation course will have major and minor
Example - science student can have Physics as Major and Music as minor also. Any combination he can choose
8. All higher education will be governed by only one authority.
9. UGC AICTE will be merged.
10. All University government, private, Open, Deemed, Vocational etc will have same grading and other rules.
11. New Teacher Training board will be setup for all kinds of teachers in country, no state can change
12. Same level of Accreditation to any collage , based on its rating collage will get autonomous rights and funds.
13. New Basic learning program will be created by government for parents to teach children upto 3 years in home and for pre school 3 to 6
14. Multiple entry and exit from any course
15. Credit system for graduation for each year student will get some credits which he can utilize if he takes break in course and come back again to complete course
16. All schools exams will be semester wise twise a year
17. The syllabus will be reduced to core knowledge of any subject only
18. More focus on student practical and application knowledge
19. For any graduation course if student complete only one year he will get a basic certificate, if he complete two years then he will get Diploma certificate and if he complete full course then he will get degree certificate. So no year of any student will be wested if he break the course in between.
20.All the graduation course feed of all Universities will be govern by single authority with capping on each course.

Now we can hope our education system will be at par with moder countries and future of our children will be bright.

The main features of The Consumer Protection Act, 2019 are as follows:-*

1. District forum is renamed as District Commission

2. The Opposite Party needs to deposit 50% of the amount ordered by District Commission before filing appeal before State Commission, earlier the ceiling was of maximum of Rs. 25,000/-, which has been removed.

3. The limitation period for filing of appeal to State Commission is increased from 30 days to 45 days, while retaining power to condone the delay.

4. State Commission shall have a minimum of 1 President and 4 Members

5. The original pecuniary jurisdiction of District Commission shall be uptil Rs. 1 Crore, State Commission from 1 Cr – 10 Cr. And NCDRC to be more than Rs. 10 crore

6. Now complainant can also institute the complaint within the territorial jurisdiction of the Commission where the complainant resides or personally works for gain besides what was provided earlier

7. Section 49(2) and 59(2) of the new act gives power to the State Commission and NCDRC respectively to declare any terms of contract, which is unfair to any consumer, to be null and void.

8. A second appeal to NCDRC has been provided U/s 51(3) if there is a substantial question of law involved in the matter

9. Power of revision can still be exercised by NCDRC U/s 58(1)(b) and by State commission under 47(1)(b) of the Act.

10. Power of review has been conferred to District Commission, State Commission and NCDRC U/s 40, 50 and 60 of the Act respectively

11. NCDRC can hear appeals against the order of Central Authority by virtue of Section 58 of the Act

12. Period of limitation in filing of complaint remains 2 years with a provision for condonation of delay power U/s 69 of the Act

13. Section 70 provides for administrative control of State Commission over District Commission and that of NCDRC over State Commission. It inter alia provides for investigation into any allegations against the President and members of a State Commission / District Commission and submitting inquiry report to the State Government concerned along with copy endorsed to the Central Government for necessary action

14. Section 71 confers power of ex*****on as provided Under Order XXI, The Code of Civil Procedure, 1908 with such limitation as provided in the section

15. Mediation is given statutory status by way of introduction of Section 74 in the new Act

16. A product liability action may be brought by a complainant against a product manufacturer or a product service provider or a product seller, as the case may be, for any harm caused to him on account of a defective product.

17. Chapter III of the Act provides for creation of Central Authority to regulate matters relating to violation of rights of consumers, unfair trade practices and false or misleading advertisements which are prejudicial to the interests of public and consumers and to promote, protect and enforce the rights of consumers as a class

18. The Central Authority shall have an Investigation Wing headed by a Director General for the purpose of conducting inquiry or investigation under this Act as may be directed by the Central Authority

19. The Act of 2019 has come into effect w.e.f. 9.8.19 and old Act of 1986 stands repealed, subject to section 1(3) of the New Act.

20. Rules regarding appointment, conditions of service etc. of the Members are to be notified soon.
