Section 125(4) CRPC Maintenance to deserted wife Once relationship of marriage comes to end, woman obviously is not under any obligation to live with her former husband Deeming fiction of divorced wife being treated as a wife can only be read for limited purpose for grant of maintenance and deeming fiction cannot be stretched to illogical extent that divorced wife is under a compulsion to live with the ex-husband Husband cannot urge that he can divorce his wife on ground that she has deserted him and then deny maintenance which should otherwise be payable to her on ground that even after divorce she is not willing to live with him.[Para 8]

State of Rajasthan v/s Ramanand CRl-A 357/08 [ ADARASH KUMAR JJ ]

[ SUPREME COURT

16/04/2020

0rder .41.Rule .27 CPC Additional evidence at appellate stage- Documents sought to be produced by way of additional evidence i.e notification issued under Land Acquisition Act, were relevant and also necessary for deciding rights of parties involved in suit - These documents did not require any proof being public documents in nature - Moreover, defendant already made reference of these documents and laid foundation in pleadings- More so, explanation given by defendant for not filing documents earlier, which was accepted by High Court Application rightly allowed.
