The Allahabad High Court recently refused to quash criminal proceedings registered against an administrator of a WhatsApp group on which an image depicting Prime Minister Narendra Modi with the face of a pig was allegedly shared in the whatsapp group.

While dismissing Malik's plea, Justice Mohd Aslam noted, "From the perusal of the record it appears that the applicant was a 'group admin' and he is also a co-extensive member of the group.

In view of the above, I do not find any cogent reason to interfere. The application under Section 482 Cr.P.C. is dismissed, accordingly."

The Court was hearing a plea filed by Malik under Section 482 of the Code of Criminal Procedure (CrPC) to quash the proceedings against him. He was charged under Section 66 (computer related offences) of the Information Technology Act.

Before the High Court, counsel for the accused submitted that the said message was not sent by him but by someone else, and that he was only the group 'admin.' Since no case was made out against him, the proceedings were liable to be quashed, it was argued.
