Utkarsh Goel and Karanveer Singh Khaira, members of CLL analyse the recent case of Ashok Ram Parhad & Ors. v. State of Maharashtra & Ors. wherein the Supreme Court held that service rules have a statutory effect and shall prevail in service jurisprudence, and that government resolutions cannot contradict the rules. The ruling came in a case between direct recruits and promotees to the position of Assistant Conservator of Forest in Maharashtra. The dispute was related to the seniority of the appointees, and the case revolved around conflicting government resolutions and service rules. The Supreme Court held that the rules were made under constitutional provisions and could not be overridden by any contrary government resolutions.
