GREAT NEWS FOR DSC PERSONNEL: PENSION PATH CLEAR! ⚖️
The Supreme Court of India, in its landmark judgment dated March 24, 2026, has cleared the way for Second Service Pension for those who served in the Army, Navy, or Air Force and later joined the DSC.
Do you have 13 years and 6 months of service? Under this judgment, you may now be eligible for pension. Here is how:
• Rounding Off Benefit (Para 18): According to the Pension Regulations, any service of 3 months or more is treated as a completed half-year. Therefore, a service of 13 years and 6 months is legally calculated as 14 years.
• One-Year Condonation (Para 44): The Court ruled that if there is a shortfall of up to one year (12 months) in the required 15-year qualifying service, it must be condoned (excused).
• Final Result: 14 years (after rounding) + 1 year (condonation) = 15 years (Eligible for Pension).
Key Highlights:
• DSC personnel are "Armed Forces Personnel" and cannot be denied a second pension.
• Restrictive Government letters from 2017 and 2022 have been overruled by the Court.
• Pension is a vested right and "Property"; it is not a bounty or a gift.
