In February 2022, the Karnataka High Court struck down the ban on real-money gaming activities. The Court's judgment hinged upon multiple aspects, with the Court construing the act of skillful gaming to be a facet of the right of freedom of speech and expression under Article 19(1)(a), the right to life and liberty under Article 21, as well as a protected business activity under Article 19(1)(g). This recognition by the Court is transformational, but, at the same time, concerns have been raised by various mental health professionals and other civic society actors about gaming addiction and other negative implications of gaming. The HC too, recognizing the same, said that online gaming needs to be regulated. Given the transformational impact and the concerns raised, it becomes necessary to engage in a holistic discussion on online gaming, keeping in mind its multi-faceted aspects.

To that end, the Law and Tech Society NLSIU along with the Sports Committee, LawNK , and The Sports Law & Policy Centre is delighted to host a Gaming Law Conference, comprising of three panel discussions. The panel discussions will be held on 30th April 2022 from 1:00 PM IST at the Allen and Overy ('AnO') Hall.

Decoding the Karnataka High Court's gaming judgment

• Mr. Pradeep Nayak: Mr. Nayak is the managing partner at Keystone Partners. He represented the lead petitioner, the All India Gaming Federation, in the case.

• Ms. Shivani Jha: Ms. Jha heads eSports Players Welfare Association (EPWA).

• Mr. Abhinav Shrivastava: Mr. Srivastava is a partner at LawNK.

Understanding Gaming Addiction and Policy Responses

The following are the speakers on the same:

• Dr. Vivek Benegal: Dr. Benegal is the Additional Professor of Psychiatry at NIMHANS.

• Dr. Anna Chandy: Ms. Chandy is a Social Psychologist and Founder of Anna Chandy & Associates.

• Prof. Saurabh Bhattacharjee: Prof. Bhattacharjee is a Professor of Law at NLSIU.

• Mr. Dibyojyoti Mainak: Mr. Mainak is working in the Policy and Law vertical for Mobile Premier League (‘MPL’), India's largest eSports & skill gaming platform with over 70 games in various genres.

• Ms. Sakina Retiwala: Ms. Retiwala is an in-house counsel at Dream Sports Inc, a premium largest fantasy sports platforms.

• Mr. Nandan Kamath: Mr. Kamath is the founder and principal lawyer in LawNK , as well as a visiting faculty and alumnus of NLSIU. Mr. Kamath graduated with a M.Sc. degrees from the University of Oxford (on a Rhodes Scholarship) and an LL.M. from Harvard Law School.

A consortium of 17 international media organizations including an Indian news portal published an investigation around a leaked list of phone numbers from across the world, named the Project. These numbers in the leaked list are allegedly the “target list” of phones hacked/to be hacked by the Pegasus spyware product sold by Israel’s Group. The target list is said to contain the numbers of prominent politicians, judges, journalists, businessmen, rights activists etc. The Pegasus allegations, whether true or not, have definitely brought back the focus on the glaring regulatory gaps when it comes to surveillance.
