In the ongoing Commune 1 dispute, the Karnataka High Court has directed parties to maintain status quo while continuing an earlier interim arrangement permitting the Co-operative Society to continue maintenance activities within the apartment complex.

⚖️ IMPORTANT APARTMENT LAW UPDATE | Karnataka High Court

In a significant ruling, the Karnataka High Court has reiterated that apartment complexes consisting exclusively of residential flats must be governed under the Karnataka Apartment Ownership Act, 1972 (KAO Act) and not under the Karnataka Co-operative Societies Act.

The Court set aside the registration of a residential apartment society formed under the Co-operative Societies Act and directed the builder to facilitate the formation of an Apartment Owners’ Association under the KAO Act.

The Court also observed that where sale deeds and declarations clearly indicate that the project is purely residential, the association must necessarily be formed under the KAO Act.

⚖️ LAND OWNERS CANNOT RETAIN PORTIONS OF LAND AFTER SALE OF APARTMENTS: Karnataka High Court

In a significant ruling, the Karnataka High Court held that once sale deeds are executed in respect of the entire property for construction of an apartment complex, the original landowners cannot later claim or retain a separate portion of the land for independent development or construction.

The Court observed that the entire land attached to the apartment complex forms part of the common areas collectively belonging to the apartment owners under the Karnataka Apartment Ownership Act. Even if certain portions were shown as “reserved” in plans, the ownership stood transferred once the sale deeds conveying undivided interest were executed in favour of apartment purchasers.
