These will help classify your claim as positive and help for speedy disposal.

Section 206 in The Motor Vehicles Act, 1988
206. Power of police officer to impound document.—
(1) Any police officer or other person authorised in this behalf by the State Government may, if he has reason to believe that any identification mark carried on a motor vehicle or any licence, permit, certificate of registration, certificate of insurance or other document produced to him by the driver or person in charge of a motor vehicle is a false document within the meaning of section 464 of the Indian Penal Code, 1860 (45 of 1860) seize the mark or document and call upon the driver or owner of the vehicle to account for his possession of or the presence in the vehicle of such mark or document.

Let us understand section 464 of Indian penal code speaks about definition of false document or false electronic record .We will see in detail in tomorrow article

Good morning friends
Today we will be going through judgment of Kerala high court regarding Drunk Driving case .

Facts of the case -
That on 21.01.2020 petitioner A drove the car in a very rash and negligent manner so as to endanger human life and dashed against another car resulting in injuries to other passenger as well as driver of car .The petitioner was booked for Section 279 and 337 of IPC along with 185 of Motor vehicle act ( Driving by a drunken person or by a person under the influence of drug ) which was challenged before the Honorable High court .

As per petitioner advocate essential of section 185 was not followed which is alcohol in blood should exceed 30 mg. per 100 ml. of blood and be detected by breath analyser .

Also in final report which was produced as evidence doctor certificate clearly speak of injuries to both .There is n o mention of breath analyser any other test conducted for the purpose of finding the alcohol content in the petitioner's blood.

The petitioner was not relieved of Section 185 of Motor vehicle Act and cannot be prosecuted for Section 185 of Motor vehicle Act. .

This year we learn some new sections as provided in Motor vehicle Amendment Act 2019 and repeal of some laws in principal Act.

We also saw example of how driving licence has a advise behind it for safe riding of vehicle for riders. We also shared some videos of how the traffic disciplined is maintained in foreign countries and same can be maintained by us voluntarily.

Why 26 th November is celebrated as Constitution Day ?

Let us the understand how Constitution protected our fundamental rights and fundamental duties .The most beautiful things it is handwritten . It is a draft which guaranteed every citizen which protected right against citizens of India.

Let us look at the various rights and State policy which has helped helped us in getting our basic rights.

Article 45-Provison of early childhood care and education to children below age of six years -The State shall endeavour to provide early childhood care and education for all children until they complete age of six years.

Article 21 -A .Right to education -The state shall provide free and compulsory education to all children of age of six to fourteen years in such manner as State May by law determine .

It was 86th constitution amendment and was inserted in 2002.

For development of society education is a basic human right .It gives person a dignity who develops himself and contributes to development of country .

Section 210 in The Motor Vehicles Act, 1988
This section explains when somebody is convicted by court under Motor Vehicle Act 1988 .Then conviction of intimation will be send to licensing authority which issued the driving licence and every such intimation shall state the name, address of the holder of the licence, the licence number, the date of issue and renewal , the nature of the offence, the punishment awarded for the same and such other particulars as may be prescribed.

Courts to send intimation about conviction.—Every Court by which any person holding a driving licence is convicted of an offence under this Act or of an offence in the commission of which a motor vehicle was used, shall send intimation to—
(a) the licensing authority which issued the driving licence, and

(b) the licensing authority by whom the licence was last renewed, and every such intimation shall state the name and address of the holder of the licence, the licence number, the date of issue and renewal of the same, the nature of the offence, the punishment awarded for the same and such other particulars as may be prescribed.

Many a times when traffic police stops our vehicle while breaking the rules we tend to escape rather than obeying .The image of traffic police in our mind deter us from running rather than stopping our vehicle. When a public officer is prevented from performing his duties then offence will be registered under section 186 of Indian penal code .

So here section 209 of Motor vehicle Act 1988 says person prosecuted for Driving dangerously or exceeding has certain exception to conviction unless on below mentioned points .

Section 209 in The Motor Vehicles Act, 1988

209. Restriction on conviction.—No person prosecuted for an offence punishable under section 183 or section 184 shall be convicted unless—
(a) he was warned at the time the offence was committed that the question of prosecuting him would be taken into consideration, or

(b) within fourteen days from the commission of the offence, a notice specifying the nature of the offence and the time and place where it is alleged to have been committed was served on or sent by registered post to him or the person registered as the owner of the vehicle at the time of the commission of the offence, or

(c) within twenty-eight days of the commission of the offence, a summons for the offence was served on him: Provided that nothing, in this section shall apply where the Court is satisfied that—
(a) the failure to serve the notice or summons referred to in this sub-section was due to the fact that neither the name and address of the accused nor the name and address of the registered owner of the vehicle could with reasonable diligence have been ascertained in time, or
(b) such failure was brought about by the conduct of the accused.

section 66 of the principal Act

66. Necessity for permits.—

The provisions of sub-section (1) shall not apply

(c) to any transport vehicle used solely for police, fire brigade or ambulance purposes

(i) in sub-section (1)-
after the third proviso, the following proviso shall be inserted, namely:—

“Provided also that where a transport vehicle has been issued any permit or permits, as well as a licence under this Act, such vehicle may be used either under the permit, or permits, so issued to it, or under such licence, at the discretion of the vehicle owner.”;
