I'm thrilled to share that I have successfully completed and submitted my dissertation titled "Beyond Courtrooms: A Comparative Study of Mediation and Litigation in Matrimonial Dispute Resolution." This research has been an incredible journey, and I'm excited to share some key insights:
๐ Mediation vs. Litigation: My study delves into the effectiveness of mediation as a more collaborative and amicable approach to resolving matrimonial disputes compared to traditional litigation.
๐ Legal Protections: I analyzed key legal frameworks, including the Hindu Marriage Act and Special Marriage Act, highlighting their role in safeguarding spouses' rights and well-being.
๐ถ Impact on Children: The research underscores the psychological effects of matrimonial disputes on children and advocates for prioritizing their welfare in legal proceedings.
โ๏ธ Challenges in Litigation: The study addresses the complexities and potential misuse of legal provisions like Section 498-A of the IPC, calling for balanced reforms to protect both victims and prevent injustices.
๐ค Efficacy of Mediation: Through various case studies, I demonstrated the success of mediation in resolving disputes, with significant contributions from Family Dispute Resolution Clinics (FDRCs).
๐ Historical Evolution: The dissertation traces the development of mediation in India, from traditional panchayats to modern ADR mechanisms, reflecting the growing importance of mediation in family law.
๐ Enhancing Judicial Efficiency: Given the overwhelming backlog of cases in Indian courts, the research advocates for promoting mediation as a means to provide timely and fair justice.
