On October 29, 2024, it was discussed that in cases of dowry harassment, allegations are often exaggerated, leading to significant consequences for entire families. Courts are urged to conduct thorough investigations as families can face severe punishments, often without any evidence against them. For instance, a man in Maharashtra was recently acquitted by the Supreme Court after spending three years in jail under false dowry harassment charges, which had caused him to lose his job as a lab assistant.

The Supreme Court, comprising Justices C.T. Ravi Kumar and Sanjay Kumar, emphasized that courts should meticulously examine such cases, highlighting past remarks about the misuse of dowry laws. They noted that Section 498A allows for dowry harassment complaints when a woman is mistreated by her husband or family, often leading to unwarranted consequences for innocent individuals.

The court referenced a previous case (Priti Gupta vs. State of Jharkhand, 2010) where it recommended changes to dowry laws due to their misuse, which has led to an increase in pending complaints and societal discord. The justices argued that it is imperative for lawmakers to consider necessary reforms to address the ongoing issues related to these laws, as the current situation continues to affect many families adversely.

The Delhi High Court reviewed an appeal from a husband seeking divorce from his wife, which had been dismissed earlier. The appeal was based on allegations of cruelty. The court, comprising Justices Suresh Kumar Kait and Neena Bansal Krishna, overturned the previous ruling and granted the divorce.

The couple, married in 1998, faced significant marital issues early on, leading the wife to leave their home in 1999. Although she returned, their relationship did not improve. The husband accused the wife of various forms of cruelty, including financial neglect, public humiliation, and making false police complaints. He argued that her behavior constituted emotional and mental abuse, making living together impossible.

The wife countered with accusations against the husband for neglect and infidelity. However, the court found that the wife's actions, particularly involving their minor daughter in their disputes, were cruel and harmful. It emphasized the negative impact of parental alienation on the child's well-being.

The court noted that attempts at reconciliation had failed and highlighted the lack of cooperation from the wife. Ultimately, the court ruled that the husband's evidence of cruelty was convincing, concluding that the relationship had become irretrievably broken and granting the husband a divorce.

In summary, the court determined that the wife's behavior constituted extreme cruelty, justifying the husband's request for divorce under the Hindu Marriage Act.

The Supreme Court of India recently clarified the standards for holding medical professionals liable for negligence. The court stated that a doctor can only be deemed negligent if they lack the necessary qualifications or skills, or fail to use the skills they possess while treating a patient.

In defining medical negligence, the court identified three essential components: (1) the duty to exercise due care, (2) a breach of that duty, and (3) resulting damage to the patient. The court emphasized that a mere mistake, lack of care, or accident does not qualify as negligence if the professional follows accepted medical practices.

In a specific case involving a minor treated for PTOSIS, the court found that there was no evidence showing the doctor or the hospital failed to exercise due care or skill. Thus, both the doctor and the institution were cleared of negligence charges.
