According to the Global Domain Report 2020 by InternetX and Sedo.com, India ranks 5th in the Domain Name Registrations of .Com, .Net and .Org. in the world.

Given the rise in domain registrations amongst businesses in India, small scale business owners are aggressively purchasing domain names for their websites/brands and thus it becomes important to know the laws revolving around it.

Netflix settled a trademark dispute with the children's book publisher behind the "Choose Your Own Adventure" series.

The dispute arose over a dialogue used in a Netflix original movie Black Mirror Bandersnatch which was a registered trademark by a company named Chooseco LLC.

Key points every brand owner should consider before filing a application:

1. If the consists of words or letters, it is recommended to file it first as a since the same gives the right to use the mark in any font, style and colour.

2. If the trademark is a mark, it is recommended to file it in black and white colour format (grayscale) since the same provides protection in all colours.

According to Section 10 (2) of the Trade Marks Act, 1999, if the trademark is registered without limitation of colour, it shall be deemed to be registered for all colours.

3. If the brand owner is registered as a private limited company / LLP / Partnership firm in India and is eligible to be registered as under Micro, Small and Medium Enterprises Development Act, 2006, it is recommended to file the application as MSME in order to avail 50% subsidy on government fees.
