On Tuesday, the Supreme Court held that a complaint in a cheque bounce case is not maintainable against a director or authorised signatory if the company itself is not made an accused.
Emphasising that a company is a "juristic person," the Court quashed criminal proceedings against a woman and reiterated the legal requirement of impleading the company in prosecutions arising under Section 138 of the Negotiable Instruments Act.
