שלום חברים,
היום משהו קצת חריג. לקוחות שלי ירשו זכויות בשני נכסים מניבים בתל אביב - 1.07% בבנין משרדים ברח' בגין, ו-2.09% בנכס המשמש כרגע כסופרמרקט ברח' ארלוזורוב. הזכויות מעניקות הכנסה קבועה מהשכרת הנכסים (בניכוי עלויות של חברת הניהול) וזכות לקבל את החלק היחסי מתמורת המכירה, אם וכאשר תהיה. אין זכויות ניהול בנכסים, ולמעשה זה מצב של "משקיע שקט". הזכויות עומדות למכירה - ביחד או לחוד - בסכומים של כ-450-500 אלף ש"ח (ארלוזורוב) וכ-550-600 אלף ש"ח (בגין).
חברת הניהול של שני הבניינים היא חברת "השתתפות בנכסים" - חברה שהיא מעין חברת בת של הסוכנות היהודית.

Why you should be aware of the exact legal position…Governments and local authorities often appropriate private lands or cause them to be transferred to the public domain, and then change their zoning in order to facilitate some public use. However, there is a significant difference in the outcome of such actions, for instance when the zoning is then reversed to its original status (a matter discussed in a judgment from the last few days in CiC (Tel Aviv District) 33008-09-13 Dan Public Transportation Company Ltd. v. the Tel Aviv Local planning and Building Committee). Well… If the land is appropriated or the owner is coerced into selling it, then upon reversion to the original zoning, the owner has the right to receive the land back. If the transfer was voluntary, that right does not apply.
When going to a real estate transaction, even one forced on you, you should have an attorney who knows how to cope with the fine print.

It is very common practice in the US to devise one’s assets by will to a trust. In contrast, in Israel it is a very unusual scenario, and therefore the authorities (e.g. Land Registrars, the Administrator General, even the courts) often don’t know how to relate to such a provision in a will. There are of course other differences as well.
In cases like these you need someone who is well familiar with both legal systems and is able to “translate” the US will to the Israeli relevant authorities.

Daily Dose of Legal Info!

In-between a court action and an arbitration proceeding:

In a recent decision by the Haifa District court (case 5930-09-21, Ziv v. Benny) it has been clarified, that once an arbitration award is issued, any temporary injunction order issued by the court (under section 16(a)(5) of the Arbitration Law 5728-1968) automatically expires, whether or not the prevailing party moved to confirm the arbitration award in court.
In the specific case at hand, the plaintiff lost the arbitration and the defendant immediately moved to revoke the temporary injunction order which placed a significant lien on its bank account. The Plaintiff objected arguing, that so long as the arbitration award has not been confirmed by the court, denial of the action does not automatically set the temporary injunction order.
As we said, the court disagreed, ruling that it does.
The case comes to show how important it is to have an attorney who is well familiar with the law, and goes down to the very fine details. We at MVCE know that it is the fine print that matters, and we’re here to serve your legal needs in Israel :)

Interesting judgment entered recently by the Israeli District Court in an appeal on road accident suit of damages. (1)
The case involves a suit of damages for bodily harm sustained by the plaintiff, who was trying to ignite his car's engine with the help of the defendant's car.
At the said scenario, the defendant 'used his car' at the meaning required by law to trigger his compulsory car insurance to compensate the plaintiff. Given that the defendant ignited the engine of the car; the car was operating on a driving park mode with hand brake; then suddenly, as the defendant went out of the car, it moved forward and crashed the plaintiff, who stood between both cars.
On the other hand, the plaintiff's car was not started, it stood mainly in a parking area on the street, rather than on the road, its doors were shut, and plaintiff himself stood outside the car and open the hood. These factors rather indicate that the condition as set out by law i.e. 'using of motor vehicle' or 'driving a motor vehicle' (2) to trigger the car compulsory insurance was not met.
Therefore, in these circumstances the court held that since the accident had been occurred because of the use of the defendant's car, rather than the plaintiff's, thus the defendant and accordingly his insurance company, shall be liable to compensate the plaintiff for his damages.

Daily Dose of Legal Info:

The Israeli government recently announced that they will be dissolving the Knesset and holding a new general election. This decision allows Prime Minister Naftali Bennett to keep a set of laws for 6 more months after they are set to expire. The laws in question grant settlers in the west bank a special legal status. Dissolving the Knesset means that any legislation that has recently been introduced will be delayed. Dissolving the government will have a major impact on the Israeli economy due to the cost of a new election and the postponement of legislation that would curb the rising costs of housing and raise the minimum wage.
