The Tel Aviv District Court has dismissed a request to enforce an international arbitration award granted by the International Centre for Settlement of Investment Disputes (ICSID) in favor of Sun-Flower Olmeda GMBH (a subsidiary of Shikun & Binui Renewable Energy and Sunflower Sustainable Investments).

The €18.4 M award, relating to Spanish solar projects, was denied enforcement due to the absence of any real connection to Israel, marking the first time an Israeli court has addressed ICSID enforcement. Although the applicants argued Israel must enforce the award under the ICSID Convention, the Court disagreed, citing a lack of connection to Israel.

The Spanish government was represented by our IL Partners Yossi Markovich, Nathaniel Agou, and Ittai Gross, as well as Associate Na'ama Israeli, showcasing our IL IP Litigation team's expertise in high-stakes international arbitration and dispute. A lengthy concluded last week when the Israeli Labor Court ruled in favor of an Air Force pilot employed by the Ministry of Defense as an instructor for cadets.

The pilot, who dedicated decades to training cadets and was dismissed at age 63—four years before retirement—claimed, through our Partner Omer Kelner of the Commercial Litigation Group, that his was and discriminatory, arguing it stemmed from safety incidents at the Israeli Air Force Flight School, where he was used as a "scapegoat" for commanding authorities’ failures.

The Court accepted the plaintiff's claims and determined that the dismissal was tainted by improper considerations, contrary to the principles of proper administration, and that the hearing process was flawed. As a result, the Court ordered the Ministry of Defense to compensate the pilot with ILS 1M.

בכתבה שפורסמה לאחרונה ב-News1 התייחסה טל רון, שותפת מחלקת הליטיגציה המסחרית במשרדנו, להשלכות המשפטיות והכלכליות של העובדה שנכון לרגע זה, לא הכירו הרשויות בישראל במלחמת "חרבות ברזל" כאירוע של 'כוח עליון' לצורך סיכול חוזים. הכתבה מביאה דוגמה אחת מני רבות למשמעות של הימנעות המדינה מהכרזה על מלחמת חרבות ברזל כ"כוח עליון": מקרה בו חוזה מופר ("מסוכל" בלשון המשפטית), אבל הצד המפר אינו חייב בפיצוי והצד האחר אינו יכול לבטל אותו. לדבריה של טל: “היעדר ההכרה מייצר חוסר ודאות משמעותי עבור המגזר העסקי. הפגיעה הכלכלית אינה מתחלקת באופן שווה, ונוצרת מורכבות רבה בהתקשרויות עם גורמים זרים.”

In a recent 'News1' article, Tal Ron, Partner in our Commercial Litigation Group, addressed the legal and economic implications of the fact that, as of now, Israeli authorities have not recognized the 'Swords of Iron' War as a “force majeure” event for contract frustration. What does this mean in practice? A case where a contract is frustrated (“voided” in legal terms), yet the breaching party is not liable for compensation, and the other party cannot cancel the contract. As Tal noted: “The absence of such recognition creates significant uncertainty for the business sector. The economic impact is unevenly distributed, and companies face serious challenges when entering into agreements with foreign parties.” This reality underscores the need for Israeli companies to manage contractual and business risks with heightened caution—especially in the international arena.
