שלום חברים,
היום משהו קצת חריג. לקוחות שלי ירשו זכויות בשני נכסים מניבים בתל אביב - 1.07% בבנין משרדים ברח' בגין, ו-2.09% בנכס המשמש כרגע כסופרמרקט ברח' ארלוזורוב. הזכויות מעניקות הכנסה קבועה מהשכרת הנכסים (בניכוי עלויות של חברת הניהול) וזכות לקבל את החלק היחסי מתמורת המכירה, אם וכאשר תהיה. אין זכויות ניהול בנכסים, ולמעשה זה מצב של "משקיע שקט". הזכויות עומדות למכירה - ביחד או לחוד - בסכומים של כ-450-500 אלף ש"ח (ארלוזורוב) וכ-550-600 אלף ש"ח (בגין).
חברת הניהול של שני הבניינים היא חברת "השתתפות בנכסים" - חברה שהיא מעין חברת בת של הסוכנות היהודית.

Daily Dose of Legal Info:

The case of Marom vs. the Attorney General established four tests that are used to determine if undue influence impacted the signing of a will. The four tests evaluate if the person signing the will was independent, did not rely on others for basic assistance, maintained relationships with family and friends, and had reasoning for writing the will the way it was written. If any of the above four statements applied to the deceased, there was no undue influence since the deceased had the mental capacity to understand their decisions and the ability to make independent choices. If the deceased does not fail all four tests, any influence on the will is considered legitimate.

New Civil Procedure Regulations to go into effect
In 2018 a revised set of Civil Procedure Regulations was promulgated, and it was due to enter into effect by...well, I don’t remember. It was postponed 4-5 times since then, and last Wednesday Israel’s new Minister of Justice announces that they will finally go into effect on January 1, 2021. I wouldn’t count on it, but he seems determined.
The new set of CPR is meant to replace the 1984 CPR and be updated to current times. Naturally there is a heated debate whether the new CPR will make things easier and clearer, or will replace old problems with new ones.
In my humble opinion the question is one of enforcement. I think that generally speaking the current CPR are fine, but for the most part courts are VERY lenient, and don’t enforce them. A new set of CPR will not change that. Will the court be more strict with the new CPR? We’ll keep you posted.

In a very recent decision by Israel's supreme court, it has been rulled that age 67 (for men) should not necessarily be deemed as mandatory retiring age. Such a rulling has vast implications including damages awarded for lost of income in personal injury cases, where damages are set based (amongst other factirs) on the plaintiff's remaining working years. I have been fighting for this for the past few years in court, and I hope now I shall find more willing judges in that respect...

Is liking something expressive activity protected by the First Amendment? Does being a Facebook “friend” create the appearance of impropriety requiring the judge to recuse himself from the case? Leave it to Facebook to make us answer these questions.
