נזקי מים בדירה - ייבוש המצע מול החלפתו

כידוע, אחת הסוגיות השכיחות בתיקי ביטוח, נוגעת לנזקי מים שנגרמים בעקבות דליפה של צנרת הדירה/המבנה וזליגתם מתחת לריצוף ולמצע שתחתיו. משרדנו סבור, כי אין לקבל באופן גורף את קביעת המבטחת לפיה ניתן לבצע פעולות ייבוש (גם במקרה שבו שיעור הרטיבות אינו חורג מהתקן), ולא כל שכן אם אחוז הרטיבות חורג מהתקן ו/או כאשר מדובר בדליפת ביוב.

בעוד שהמבוטחים מעוניינים בהחלפת הריצוף והמצע שנרטב, הרי שמנגד המבטחות עומדות על ייבוש המצע באמצעות ייבשנים והותרת הריצוף על כנו. כמובן שמשמעות ייבוש המצע הינו חסכון כספי למבטחות אשר אמורות לפצות את המבוטח בקרות האירוע ולהשיב את המצב לקדמותו. השאלה אם ייבוש המצע מהווה השבה לקדמות. הסוגייה שנדונה - האם על המבטחת "להשיב את המצב לקדמותו" על דרך של החלפת המצע והריצוף (כטענת המבוטח), או שמא יש באפשרות המבטחת להסתפק בייבוש המצע באמצעות הנחת ייבשנים בדירה, ולהביא את רמת הרטיבות עד לרמה אשר לשיטת המבטחות הינה הרמה "המותרת" על פי התקן הישראלי.

סוגייה זו נדונה בהרחבה בת.א 7053-01-13 אקא נ' ישיר. בית המשפט קיבל את תביעת המבוטח, תוך שחידד במסגרת פסק הדין, בין היתר כי: בפוליסה לא צוין שחובת המבטחת נעצרת בקו של 6% אחוזי לחות. בפוליסה לא צוין שהמבטחת רואה עצמה פטורה מלהוריד את רמת הלחות של מצע המילוי מתחת ל- 6%. בפוליסה לא צוין כי המבטחת תהא רשאית לבחור במסלול של יבשנים חלף החלפת מצע החול. בפוליסה לא צוין מהן אמות המידה לבחירה בין מסלולי השיקום [רמת לחות, טיב המצע, משך הייבוש]. בפוליסה לא צוין מהם הקריטריונים לאימוץ מסלול של שיקום חלף פיצוי. בפוליסה לא צוין שהמבטחת רשאית לנסות תחילה את מסלול היבשנים, ולאחריו לפנות למסלול חלופי.

בית המשפט קבע כי ציפיתו של מבוטח סביר היא כי בקרות מקרה הביטוח, חב' הביטוח תפעל בזמן סביר ותפעיל את האמצעים הסבירים העומדים לרשותה לתיקון נזקי הרטיבות. בפועל, המבטחת סייגה את חבותה כלפי התובע מעבר לרשום בפוליסה, תוך ניצול העמימות החוזית, ובמתן משקל יתר לשיקולי העלות, ומשקל חסר לרווחת המבוטח.

בהקשר לסוגייה זו יושם אל לב, בין היתר כי: המבטחות והגורמים מטעמם אימצו תקן העוסק באופן עקרוני בעבודות בנייה חדשות, בעוד שבדרך כלל מדובר בנזק למבנה קיים שכבר עומד מס' שנים על מכונו. ישנם מומחים הגורסים כי גם רטיבות של מים בשיעור שאינו עולה על 6% ממשקל החול גורמת לנזק וכן כי אם המים נותרים כלואים ברצפה במשך שבועות רבים, אף בכמות קטנה של אחוזים בודדים יש בכך סכנה ממשית. כאשר מדובר במי ביוב שזלגו למצע הריצוף, ברי כי ייבוש המצע לא יהא בו להשיב את המצב לקדמותו.
