Unified Patent Court (UPC) issues the first Preliminary Injunction Order

The potential advantage of electing a unitary patent has recently been exemplified, when 10x Genomics was granted a preliminary injunction, preventing its competitor NanoString from selling its RNA detection instruments and reagents in the 17 European Union counties by a single action at the Unified Patent Court. For completion, it is noted that in one of the 17 countries, Germany, NanoString had already been injuncted in a previous action. The suit was filed at the UPC on its opening day (June 1) and was based on alleged infringement of the 10x unitary patent EP 4 108 782 B1, covering in situ detection of analytes. NanoString is expected to appeal the decision and argue, inter alia, to invalidate the patent. If the decision is upheld, then 10x would have benefitted from this single action giving rise to injunction in 17 countries. On the other hand, if the patent is invalidated, 10x will lose this patent in 17 countries all at once.
