I am often asked to advise in relation to farm transfers. In general, these are transfers from father to son sometimes from father to daughter. The piece I might advise on is in regard to the consent of the wife to the transfer of the family home. I find quite often the discussion might be had in relation to the transfer of the farm as a purely business decision. Farms are where families live their lives. Those lives are very often made by the spouse of the farmer who may be contributing her own income to the family and be hugely supportive of their hard-working farmer. No one for a minute can say that farmers do not work hard but the voice of their spouse in relation to transfers is very important.

I have this photo of my aunt Mamo on a shelf behind me in the office. She was one of the most effective voices for women and encouraged women to have a voice. As a mother of 11 amazing children and widowed at a young age I do not know where she found the energy and the passion to be so eloquent on these matters.

The point of this post is that a family farm transfer is just that. It should involve all of the family. It should take account of the life that the retiring farmer and spouse wish to lead and should be planned for accordingly. As I turn around in every consultation and point out Mamo I channel what she would have said on the subject . So when thoughts of succession and farming come up the first thing to do is make a big pot tea and sit around the table and chat the whole thing out involving everyone. These transfers are big deals and should be treated accordingly.
