Is there the potential for Fraud? - Abuse can be minimised with proper pre-planning and appointing, but no amount of legislation will deal with people who want to do bad things and abuse people. However, having said that we have no proper adult safeguarding legislation. We have very large figures for abuse even though we don’t capture them on a national basis, but the figure that is captured by the HSE would indicate say in 2017 about 10,000 cases of concern. That was increased in 2018 up by about 25% because Safeguarding Ireland did a public awareness campaign about this and another piece of research, indicates that 10% of the Irish population has witnessed abuse in the previous 12 months. Now if you extrapolate that to say that there are 3.8 million adults in Irish society, that would imply that 380,000 people have witnessed abuse. Very few of them are reported because we don’t have the proper legal framework or legislation to tell us who to report to. It is one thing to report and incident to the HSE, whilst in care. However most of the abuse takes place in the community where people are not interacting with services. A lot of the abuse, particularly of older people, is financial abuse. We need a mechanism to identify what abuse is, to understand it is abuse, to detect it and to ensure that the perpetrators are actually caught. There may be criminal offences and even if people are pilfering the pension or doing people out of other income for example, such as family members collecting the pension and keeping some of it, that is theft.
There is a huge area of psychological abuse of people of very vulnerable people who are under the control of somebody. This is a huge issue, and again as a society, we have to embrace that issue and recognise that we have to do something about it. We need adult safeguarding legislation which also should have a mechanism to put in procedures and policies to prevent abuse and when others of us see it and should call it out and make sure it is addressed.

The role of solicitors in Ireland is a qualified legal professional who provides expert legal advice and support to clients on both contentious and non-contentious business. A Solicitor's clients can be individuals, groups, private companies or public sector organizations. Solicitors seek the expert assistance of barristers on issues that they feel require further opinion and in the preparation of litigation.

Barristers can be distinguished from a solicitor because they wear a wig and gown in court. They work in the superior courts and their main role is to act as advocates in legal hearings, which means they stand in court and plead the case on behalf of their clients in front of a judge.

The Constitution divides the authorities of the State into three separate law-making entities – the Government, the Judiciary, and the Legislature. Each are independent of one another, and each have their own specific powers and functions.

There are many business structures available in Ireland, some of which do not require the creation of a separate legal entity. A company is a separate legal entity to its members, unlike a sole trader or partnership where the owners of the business and the business itself are one and the same.

Company Limited by Shares (LTD) - The Companies Act 2014 introduced two new types of a company, a Company Limited by Shares (LTD) and the Designated Activity Company (DAC). The old LTD (Private Limited Company) was disbanded, and the new LTD and the DAC were created. The DAC is like the old LTD in its makeup.

Is there an ideal age for doing that?

A piece of recent research indicated only 6% of the population had done an Enduring Power of Attorney, and they were in the older age grouping. It is really important even when you are younger to have an EPA and an AHD so in the event of there being a critical situation such as a road traffic accident for example that documentation is in place. This is one of the significant issues in terms of the State being of assistance. The State should have a national campaign to encourage advance decision-making, for the simple reason that a lot of the delay in discharges from hospital arises because people are not aware that they can consent to treatment or to where the place of care decision in an AHD or managing their finances in an EPA. We end up with very expensive care in acute beds, with huge delays and not enough appropriate care for the person because we are waiting on a wardship application which may take months. Therefore it is really important, and more and more when the Act is fully commenced, healthcare professionals and others will want to know what a person’s wishes are and the best way of articulating my wishes are to write them down.

In Ireland the legal profession is divided between solicitors and barristers and sometimes there is confusion between the two roles which actually exists to complement each other.

Both sides of the profession have different legal qualifications, with solicitors qualifying from the Law Society at Blackhall Place who are then admitted to the Roll of Solicitors Ireland. Barristers qualify from the Kings Inns and are subsequently called to the Bar of Ireland.

The role of a barrister in Ireland is a type of lawyer who specializes in court advocacy and the giving of legal opinion. Barristers do not handle clients’ funds, provide safe custody of original documents, or provide the normal non-contentious services which a client would expect from a firm of solicitors. Instead, barristers are retained for specific cases, primarily as advocates. Solicitors tend to call upon the services of barristers to present their cases in the higher courts.

Ireland has a Common Law legal system, similar to that of the United Kingdom, however, Ireland is different to Britain in that it has a written Constitution. The current Irish Constitution – Bunreacht na hÉireann – was ratified by the Irish people in 1937 and is the fundamental law of the state. It defines the functions of the State and its agencies, provides for the fundamental rights of Irish citizens and sets out the separation of powers in the state.

A parent or family member has signs of mental incapacity and they are not allowed leave their residential or healthcare facility - does this sound familiar?

A person always has the right to have their voice heard or represented in any process concerning them. If the person cannot speak for themselves then they must have a legal representative or other advocate who is otherwise not involved in the dispute appointed to hear their voice and represent it to the court.

It must be borne in mind that a person’s lack of capacity to make a decision does not mean they can be detained in a residential or healthcare facility against their will. People with impaired mental abilities are protected by the same constitutional guarantee as any other person – that they will not be deprived of liberty. Similarly, the fact that the measures taken by the healthcare facility are in the best interests of the person is a matter that goes to the justification of deprivation of liberty, and not to the question whether there was in fact a detention.
