A member of An Garda Síochána who failed a physical fitness test has obtained a temporary injunction from the High Court that prevents the Commissioner from dispensing with his services.

The garda claimed that it was "manifestly unfair" for his probation to be continually extended by the Commissioner only to be later terminated on the grounds of an early failing.

New figures have revealed that fifty-seven judgements are backlogged in the High Court by over two months, and that a further six cases have been awaiting a decision since 2019. In 2020, 434 cases were delivered by the High Court, which saw an increase from 349 the previous year.

Mr Justice Barrett of the High Court has condemned individuals who purport to assist indebted homeowners, in arrears with their mortgages, and facing repossession of their family home. In a written judgment, the Judge rebuked what he described as ‘fraudsters’ who preyed on vulnerable litigants by ‘selling them a crock of nonsense’ that there were some legal tricks to avoid paying their mortgage. He described the arguments made by the two individuals as legal oddities and noted that they had relied upon strange documents to denied that any debt was owing to Start Mortgages.

A man who was prescribed an antipsychotic drug has settled a High Court action against the HSE for €1.2 million after developing a movement disorder as a result of the medication.

Despite his deteriorating health, the man was advised to continue taking the prescribed medication.

The Personal Injuries Assessment Board has recorded a noticeable decrease in injury claims, declining by 26,009 cases, or 16%, last year. It is believed that this fall was due to COVID restrictions, resulting in a drop in motor accidents and public liability injuries.

The PIAB detailed that awards declined by €70 million on the year to about €206 million, and were down €92 million on 2019.

A high court challenge has been brought by a Monaghan-based Sheriff to overturn the Minister for Justice’s decision that the man must retire by the time he is 70 in May 2022.

A trainee solicitor who claims that he was paid the equivalent of five euro an hour at times by his former employer has been awarded €22,439 by the Labour Court.

The complainant told the court that he would often work between 50 and 60 hours a week, inclusive of his hours spent at lectures.

A family has been awarded a settlement amount of €57,500 in their High Court action over the death of a man whose brain injury was allegedly not adequately assessed. The man, aged 56 and a father of six, had been found on a footpath in the early hours of December 6th, 2017. He was taken to Naas General Hospital and died the next day.

A consultant surgeon contested that it was not reasonable for the ambulance personnel to assume that the deceased had not suffered a trauma.

A woman has settled her High Court action for €250,000 after her husband died while attending a stag party in Galway city in June, 2017. The court heard how the husband and father of one from Wales had left a pub in the city after spending eight to nine hours on the premises. While attempting to go back to his hotel, he became disorientated and ended up on a road outside of the city when he was hit by a taxi in the early hours of June 17th.

Although the injured man was brought to University College Hospital, Galway, after the incident, his situation quickly deteriorated due to a brain injury, and he was pronounced dead a short time later.

An 11-year-old boy has settled his High Court action €7.5m following an alleged delay in the diagnosis of a brain tumour.

When the boy finally underwent an MRI scan, it showed a significantly large tumour on his brain.
