⚠️ State Is Failing Injury Victims As No Insurer Of Last Resort To Compensate People Struck By E-bikes And Scooters

In the last three years, Gardaí have recorded over 1,500 traffic incidents involving e-scooters including several tragic fatalities.

The growing use of e-scooters has led to the introduction of the Road Traffic (Electric Scooters) Regulations 2024 to improve safety and accountability. While originally designed as mobility aids for older people and those with disabilities, e-scooters and e-bikes are now widely used, raising concerns about safety and the lack of insurance cover for accidents caused by negligent use.

There is increasing public concern that injuries involving e-scooters and e-bikes (with speeds under 25 km/h) may not be covered for compensation, as the Motor Insurers Bureau of Ireland (MIBI) has stated it will not cover claims arising from collisions with these vehicle.

Commenting on more examples of personal injury victims being penalised Liam Moloney of Moloney & Co. Solicitors said today “while the new Regulations bring clarity to the Law on E-bikes and E-scooters by updating the definition of pedal bicycles and pedal tricycles to include those equipped with auxiliary electric motors the Government should immediately amend the MIBI agreement to ensure people injured by their negligent use are fully compensated”.

Our Managing Partner, Liam Moloney, has been elected as the new President of the Pan European Organisation of Personal Injury Lawyers (PEOPIL), becoming the first Irish lawyer to hold this position.

PEOPIL represents over 500 members across 30 European jurisdictions and works to promote access to justice for injury victims and strengthen cooperation across Europe in the field of personal injury law.

Speaking about his appointment, Liam said:

“I am honoured to have been elected as the first Irish Lawyer to serve as President of the Pan European Organisation of Personal Injury Lawyers. Regretfully, access to justice in many European countries, including Ireland, continues to be eroded for personal injury victims through unjust reforms. Liam Moloney, International Personal Injury Lawyer has been invited to speak at the American Association of Justice’s Annual Convention in San Francisco.
Liam will speak about international cross border cases and how to get compensation for personal injuries suffered while staying in Airbnb holiday rentals and he will explain about the legal responsibilities of online booking platforms.

Speaking about how such cases can be very complex Liam said “2024 saw new records in the EU, with 854 million nights spent in accommodation booked via four online platforms. Airbnb has almost 8 million listings worldwide which shows the huge wider global popularity of major online booking platforms.

If things go wrong and someone suffers a serious injury in a holiday rental they need to know what their legal options are and who might be responsible to compensate them for their injuries.”

A Statutory Inquiry must now be urgently established following the CHI Developmental Hip Dysplasia Audit, which investigated pelvic osteotomies performed on children aged one to seven at Temple Street, Crumlin, and Cappagh Hospitals.

The audit, led by Mr. Simon Thomas of Bristol Royal Hospital, has raised more questions than answers, particularly around why so many surgeries were carried out and whether proper consent was obtained.

Liam Moloney, a Naas-based solicitor advising affected families, stated:
“It has now been conceded that many of these surgeries were unnecessary. Complex hip operations on children over five or six can carry significant long-term risks. These concerns must be addressed fully and transparently.”

Only a full Statutory Inquiry can uncover how this happened and ensure it never happens again.

A recent study has found that prolonged use of an injectable contraceptive known commonly as Depo-Provera or Sayana Press is linked to a higher risk of developing meningioma, a brain tumour affecting the membranes around the brain and spinal cord.

Following this, the Health Products Regulatory Authority (HPRA) issued a safety warning in October 2024. Pfizer, the manufacturer, cooperated with the notice. The study reported a 5.6% increased risk with long-term use.

Moloney Solicitors are investigating claims for individuals who developed symptoms such as vision changes, headaches, seizures, or weakness after using these contraceptives for over a year.

Following the recent CHI audit into developmental hip dysplasia surgeries, serious concerns remain about the high number of pelvic osteotomies performed on young children at Temple Street, Crumlin, and Cappagh hospitals. The report recommends follow-up to skeletal maturity for all 497 children operated on between 2021 and 2023. Questions around surgical decisions, informed consent, and long-term impact continue to grow.

Solicitor Liam Moloney, representing a number of affected families, has called for independent paediatric orthopaedic surgeons to urgently review medical records and provide clarity and reassurance to parents.
