Women's Medical Negligence

Women's Medical Negligence We specialise in representing Women who have been the victim of Medical Negligence. This is the case that finally decided the status of the unborn in Irish Law.

James McSweeney has a special interest in Medical and Clinical Negligence* claims. Prior to setting up his own practice in 2007, James managed one of Ireland’s leading specialist Medical Negligence* and Personal Injury* firms. He has experience in all Courts from the District Court to the Supreme Court, including the Supreme Court case of Roche –v- Roche. This is, arguably, the most important leg

al case in the history of the Irish State. In his Judgement, the Chief Justice noted that the issues raised were… “profound and complex on novel aspects of birth, the right to life and reproductive rights”. James has been at the cutting edge of developing innovative and quicker ways of winning cases for victims of medical accidents. The systems he has developed enable his Clients to prosecute their cases with confidence. We understand that when a Client comes to us they would like a sensible resolution to their problems within a reasonable time frame and at a fair cost. We choose our Clients carefully and our Clients recommend us to their friends and family. We enjoy getting excellent results and surprising our Clients with exceptional and personal service.

Today we had the privilege of representing the family of Martin Staines who died tragically because of failings in care at St James Hospital in Dublin. In their quest for justice, the family were the model of tenacity, patience and dignity. As part of the settlement, the hospital issued an apology, the sincerity of which is recognised and appreciated. Martin’s wife and widow, Lorraine made a statement in Court on behalf of herself and her family. We are enormously proud to have been chosen to represent this wonderful family.

Father of five, Martin Staines, from Tallaght, Dublin, suffered a fatal reaction to an agent known as polyethene glycol, which was in the steroid injection.

Ireland currently has limited specific regulation for cosmetic procedures.
Surgeons performing major cosmetic surgery must be fully qualified doctors registered with the Irish Medical Council.
However, non-surgical cosmetic treatments (e.g., Botox, fillers, laser treatments) are less strictly regulated. These can sometimes be administered by beauticians, nurses, or unregulated practitioners, leading to a higher risk of negligence.
There is no dedicated “Cosmetic Surgery Regulator” yet, though the Health Products Regulatory Authority (HPRA) oversees medicines and devices like Botox.
