In my teenage years, I represented Ireland on the U18 Irish Netball Team and also, for many years, the Irish Tetrathlon Team. “No one likes to think about the breakdown of a marriage/relationship when buying your first house or any property however making the proper provisions in the event that there is a breakdown is very important

Top Tips:-

Co-habiting- Consider putting a Co-habitation Agreement in place. Such an Agreement must be in writing & both parties must obtain independent legal advice prior to entering the Agreement

Preparing to get Married - Consider putting in place a Pre-Nuptial Agreement. Such Agreements are not legislated for in Irish Law, they are still nevertheless persuasive when the Courts are deciding upon the terms of a Separation/Divorce application.

Married Couples – married couples purchase property as joint tenants so that if either dies, the ownership transfer into the survivor’s sole name. If the marriage breaks down, irrespective of the contributions to the property the courts will determine the split of assets with a view to making proper provisions for all parties involved

Mediation - If there are no agreements in place, mediation/collaboration is always encouraged and advised as it is very useful & can assist without the necessity of ‘fighting it out’ in Court.

ENDURING POWER OF ATTORNEY.
When drafting your will you should also consider executing an Enduring Power of Attorney (EPA). This important document allows you to appoint an Attorney (someone you trust) who will manage your affairs, and usually your daily needs, from clothing to food, in the event that you become mentally incapable of looking after yourself.

The implications of not having appointed an EPA would mean that you would become a ward of court. This High Court application is both costly and not personal so we advise all clients to consider this appointment when preparing and executing their will. For more details on this please contact us.
