A Family Limited Partnership may allow parents to pass on value while retaining control of the business. A Discretionary Trust may provide greater protection where children or other beneficiaries are young, vulnerable or not yet ready to manage significant assets.

Your medical records can help you understand what happened during your care, seek a second opinion or investigate concerns about the treatment you received.

You have a legal right to access the personal data held about you by a hospital, GP or other healthcare provider. But knowing where to send your request, what to include and when you should receive a response is not always straightforward.

This guide explains how to make an Article 15 Subject Access Request, which records you can ask for and what to do if information is missing or the response is delayed.

It also covers why requesting your records should not delay legal advice if you are considering a medical negligence claim.

For survivors of historical child sexual abuse in Irish schools, the MacGrath Commission may raise questions about whether their individual case will be investigated or compensation will be available.

The Commission has been established to examine how allegations and concerns relating to abuse connected with Irish schools between 1927 and 2013 were handled.

Its work will include a formal investigation using selected sample cases and a separate Survivor Engagement Programme, where survivors can share their experiences through an informal, non-adversarial and anonymised process.

However, the Commission’s role is to investigate and report. It is not a court, it will not determine every individual case and it cannot award financial compensation.

Its final report may not be published until 2030. Survivors do not have to wait until then to seek legal advice about whether a separate civil claim may be available to them.

When an emergency C-section is called, every stage of the timeline matters.

The theatre log should record when the decision to deliver was made, when theatre was prepared, when the procedure began and when the baby was born.

Clinical guidance generally sets a target of 30 minutes for a Category 1 C-section, where there is an immediate threat to the mother or baby, and 75 minutes for a Category 2 C-section, where there is compromise but no immediate threat to life.

A delay beyond these timeframes does not automatically prove medical negligence. The wider circumstances, the CTG trace, the reason for the delay and whether earlier delivery could have prevented or reduced the injury must all be independently assessed.

For families trying to understand whether a birth injury was avoidable, the decision-to-delivery interval can be one of the most important parts of the medical record.

Questions about a will can begin with a difficult concern: did it truly reflect the person’s wishes, or were they placed under pressure?

A will that feels unfair does not necessarily amount to undue influence. Under Irish law, the pressure must have been so significant that it overcame the person’s own decision-making and the will no longer reflected their genuine wishes.

The evidential threshold is high, and the circumstances surrounding the will require careful examination. Even where undue influence cannot be established, concerns around mental capacity or whether the person understood and approved the will’s contents may still need to be considered.

In this video, Claire Tuohy explains this important distinction and why specialist advice can help families understand whether there may be grounds to challenge a will.
