It has not yet clear how many passengers were affected by the data breach relating to boarding passes issued for flights during August, but RTÉ News understands it may be in the hundreds of thousands.

Update: All data breach cases in Ireland were on hold until the 29th of July this year awaiting the Supreme Court decision in Dillon v Irish Life Assurance plc [2025] IESC 37.

The Supreme Court ruled that you can recover for upset, distress and anxiety for a data breach under GDPR without the need of getting medical reports or seeing a doctor.

This means that all the data protection actions (including all the HSE cases) were on hold until the Supreme Court ruled. Now all these cases can proceed (many thousands) but it’s going to take a while for the courts to get through each one in turn. Everyone who has a case will be dealt with in due course but no-one can speed the courts up, it will take time but Dillon is a very good outcome for everyone who has a case. If you got a letter from the HSE stating your personal/medical data was stolen click on www.argentlaw.ie/hse to see if you're entitled to compensation.

Over 113,000 people had their personal data and medical data stolen in the HSE data breach in May 2021 and the HSE took years to notify people – this delay is unacceptable.

The HSE data breach occurred in April-May 2021 but the HSE only started notifying data subjects from November 2022 onwards, and are still notifying people to this day, with no explanation for the delay.

The Irish Supreme Court ruled a person can get compensation for mental distress, worry, fear, upset, inconvenience and anxiety for a data breach without the need for a medical report or authorization from the Injuries Resolution Board.

This makes it easier to claim for compensation under GDPR.
