As the Government has requested all but essential workers to stay at home, if your bail conditions require you to sign on at a Garda station, during the two week lock down, you won't be required to attend the Garda Station, but you should have a mobile phone working that the Gardai can contact you if they require to make contact with you. THIS IS A TIME FOR US ALL TO THINK OF OUR LOVED ONES, GRANDPARENTS, MOTHERS, FATHERS, PEOPLE WITH AN UNDERLYING ILLNESS, WE DON'T WANT THEM TO GET ILL AND DIE, PLEASE PLEASE COOPERATE WITH THE AUTHORITIES STAY AT HOME FOR THE NEXT TWO WEEK, Don't have it on your conscience that your actions caused people to get ill and die. An enduring power of attorney is normally made when a person has full capacity. It requires evidence from a doctor that they have full capacity when executing the deed and will only come into force should they lose full capacity which has to be evidenced by a doctor.

Mental Health...

Increasing numbers of people in our society suffer from mental health.

Mental health is an illness like any other and you should seek help and treatment through your GP who can refer you to the right service.

Many people with mental health don't seek help and end up in a very difficult position which sometimes can result in criminal charges and before the courts.

If you or your loved one are suffering from mental health illness, we would strongly advise that you do not suffer alone - You are not alone, you should not suffer alone.

Many people, due to pressures of life, relationships, work, alcohol, drugs end up suffering with mental illness and we would encourage in he first instance to seek help from your GP.

Drink Driving...

What should you do if you are arrested for drink driving?

Firstly, Monahan Solicitors would not condone any person drink driving.

If you are arrested, convicted and disqualified for drink driving - The cost of the taxi fare would look like great value!

Should you find yourself arrested, we would advise that you comply with the request of the gardai to give a sample if requested as failure to comply with giving a sample results in a mandatory (Judge has no choice) 4 year disqualification from driving whereas if you give a sample the reading could result in a disqualification from 1 - 3 years.

REMEMBER - A Taxi is ALWAYS a cheaper and safer option!

WARNING WARNING WARNING!!!

In particular to young people and drugs...

We are seeing more & more young people being offered drugs on tic (credit).
This is a process whereby drug dealers will give drugs to children as young as 12/13 years of age on credit, knowing that the kids don't have the money to pay for the drugs.
Young people then develop a dependancy on drugs without realising.

Their debts can run up to hundreds or thousands of euro. Pressure is then put on them to pay the debt with threat of severe injury or threat to burn the family home.

These threats are very real and cause great stress and anxiety to the young people involved and they often end up turning to crime to pay off the drug debt or comply with the directions of the drug dealers involved.

We STRONGLY advise young people NOT to engage in the taking of drugs and NOT to buy on tic.

The first step in trying to deal with drug problems is realising that there is a drug problem. RELATIONSHIP BREAKDOWNS:

In Family Law when a relationship breaks down and children are involved and the parents end up in the Family Law Court it will be either one of the following;

1. The mother will be seeking maintenance from the father of the children.
2. The father will be seeking to be appointed a guardian (if they are not married) and seeking access to the children.
3. If the parties parting are married both of them are automatically guardians of the children and the main issues that arise there will be the mother seeking maintenance for the children and herself and the father would be seeking a Order from the Court granting him access to his children.

An example of the maintenance that a Court can order a working father to pay can be in the region of €100 per week for a child if the father is earning in or around €500 per week. If there was two children the Court might order maintenance in or around €120 for the two children.

If a person is unemployed a Court might order €20 per child per week.

The amount of maintenance that a Court might order is dependent on the ability of the person who has to pay the maintenance to pay it.

Normally both parties will have to fill in a Statement of Income and Expenditure showing the money they have coming in and the money they have going out so that a Court can access their ability to pay maintenance and the needs of the person looking for the maintenance.
