LANDOWNERS SUCCESSFULLY FIGHTNG THE NEW RESIDENTIAL ZONED LAND TAX (RZLT), but new deadline for farmers.

I wrote an Article about the unfairness of this Land Tax back in December 2022:

As pointed out by this Article in the Irish Independent on Tuesday, County Councils (who have zoned lands for the Tax) received a Circular from the Department of Housing just before Christmas telling them that they should allow applications from farmers for rezoning of land to something other than residential from farmers whose land was zoned for the new Tax, but who want to continue farming, BUT IT APPEARS THAT APPLICATIONS MUST BE SUBMITTED IMMEDIATELY.

Farmers should contact their local Councils for further information on how this Application should be submitted and the time limit for submitting the Application.

AN AVERAGE ARTICLE BY THE IRISH TIMES

A lot of homeowners may not be aware of "the Average Rule" when it comes to renewing your Home Insurance.

The Average clause is often added to insurance policies and can be found in the small print of your insurance documents.

The Average clause is a way for insurers to pay out less than they need to if a policyholder is paying less than the premium they should have, because they have inadequate cover.

Insurers apply the Average clause and only pay out a proportionate amount of what you are claiming, based on how much by which you were underinsured.

For instance, if your house is only insured for 50% of its rebuilding cost, you may only recover 50% of your Claim for damage caused by a flood.

Do not just insure for the market value, but for the actual rebuilding cost. If unsure, consult a Chartered Surveyor on the rebuilding cost.

Growing number of policyholders don’t have adequate cover and will be out of pocket if they have to make any claim for damage

EXECUTING AN ENDURING POWERS OF ATTORNEY UNDER THE ASSISTED DECISION-MAKING (CAPACITY) ACT 2015 – IT WAS NEVER GOING TO BE EASY!

There has been a lot written on this by both the Law Society and the Decision Support Service (DSS). I have tried to summarize what has happened in this Guide.

There are a number of takeaway points:
# the completion of Enduring Powers of Attorney (EPA`s) was an easier process under the old system;
# matters have now become more complicated under the new DSS "Digital First" Online system;
# this is further complicated by the fact that all EPA`s must now be registered with the DSS (delaying the effective legal validity of the document until registration is confirmed by the DSS);
# the advice issued by the Law Society that Solicitors should not partake only in the ex*****on of the Legal Statement is correct - where the Solicitor has not been involved in the process from the start;
# the creation by the DSS of a Solicitors Portal on the DSS website (similar to the Solicitors Portal on the Injuries Board Resolution website) is the proper
solution;
# pending all of this however, it is possible for the Solicitor to go through the new EPA process up to and including the registration of the EPA through the client`s Portal - we know: we have completed the process and uploaded the documents to the DSS website for registration. It`s not totally satisfactory, but it`s working as an interim solution.
