At McCarthy + Co, our family law team regularly advises parents who are considering relocating internationally with their child following a separation. For some, it may be a desire to return home to be closer to family support. For others, it may involve a new job opportunity, a relationship, or the hope of a better quality of life.
However, where the other parent is a guardian of the child, relocating abroad cannot usually happen without:
✔️ The consent of the other parent, or
✔️ Permission from the court
Taking a child abroad without the appropriate consent can have very serious legal consequences, including potential child abduction proceedings under the Hague Convention.
In our latest blog, we explain:
• The legal considerations involved
• The factors a court will take into account
• The practical steps in making — or responding to — a relocation application
