TIME IS RUNNING OUT

If you benefit from a right of way or other form of easement, such as one on which services, septic tank, percolation area etc. run, then you must register that right of way or easement on or before the 30th of November 2021.

This requirement was introduced by the Land and Conveyancing Law Reform Act 2009. The 2009 Act initially allowed a period of 3 years within which to register these easements but this was subsequently extended to 12 years.

So why do we say that time is running out?........The Act was enacted in 2009, more than 9 years ago. The extended registration period of 12 years is now more than 75% passed and yet the majority of rights of way and easements remain unregistered. The process takes time. A Land Registry compliant map has to be prepared. The consent of the landowner has to be obtained and if the landowner will not consent then other procedures have to be utilised, all of which take time.

Have you made any New Year’s resolutions?
Why not take the “Make a Will” health check by answering the following questions:
1. Have you made a valid Will, if not, why not? One made at home may not be valid.
2. Have you recently married? If yes, did you know that marriage revokes a Will?
3. Have you children under 18? If yes, then it is your duty to make a will in order to protect their future.
4. Do you own a house, land, jewellery, car, bank account, shares or other property? If yes, then who would you pass them on to when you die?

Major Change in Criminal Justice Procedure:

A significant change in Criminal Justice Procedure took place on the 7th May 2014. A directive from the Director of Public Prosecutions was issued to An Garda Siochana which states that from now on, suspects detained for questioning at a Garda Station will be entitled to have their Solicitors present during their questioning.

A separate Department of Justice committee has also been established to report on a proposed form of words to replace the traditional caution which is “You are not obliged to say anything unless you wish to do so, but anything you say will be taken down in writing and may be given in evidence”. This traditional caution has been eroded by the introduction of “inferences” which can be drawn at trial which can adversely affect the defence of an accused person where the accused refused to answer questions or failed to mention facts deemed material to their defence.

Mental Distress in Wrongful Death Cases:

The maximum amount of damages for mental distress that can be awarded to the dependants of a deceased person in wrongful death cases, under Part IV of the Civil Liability Act 1961 (as amended), has been increased.

The amount has increased from €25,394.76 to €35,000, with effect from 11th January, 2014.

This new limit for solatium, as it is called, reflects the increase in the CPI since the limit was last modified in 1996. It is still a relatively small amount when compared to the distress dependants suffer. There are of course other elements of damage than can be claimed in addition to it.

Court Limit changes: From the 3rd of February 2014 the limits of how much compensation each court can award will be changed as follows:
The District Court limit will increase from €6,384 to €15,000.
The Circuit Court limit will increase from €38,092 to €75,000, except in personal injuries cases where the new monetary jurisdiction will be €60,000.
There is no limit to the amount the High Court can award and this remains the same. There hasn’t been an increase in general jurisdictional limits such as this since 1991 thus it’s significance.
