Since Indonesia joined the Hague Apostille Convention in 2022, getting Indonesian documents authenticated for use abroad has become much simpler — but it still requires the right process, in the right order.

Apostille, notarization, consular legalization — each applies in different situations. Using the wrong method, or the wrong sequence, causes delays.

KITAS or KITAP — do you know the difference, and which one applies to your foreign worker in Indonesia?

KITAS is the standard limited stay permit for most foreign workers — tied to the sponsoring employer, valid for up to two years. KITAP is the permanent stay permit, but it is only available to specific categories: foreign spouses of Indonesian citizens, former Indonesian nationals, and certain investors. Length of employment alone does not qualify a foreign worker for KITAP.

An Exit Permit Only (EPO) in Indonesia is generally required when a foreign worker leaves Indonesia before their ITAS expires.

If the ITAS expires naturally, cancellation will generally occur automatically through Indonesia’s integrated immigration system.

However, employers should remember:

• EPO processing usually must happen before ITAS expiry;

• the foreign worker should still be in Indonesia; and

• Kemnaker work permit cancellation remains mandatory.

Incorrect cancellation procedures may create future immigration compliance issues.

Not always.

Foreign shareholder-directors, commissioners in PT PMA companies, diplomatic staff, and emergency technical workers may qualify for an RPTKA exemption — but conditions apply.
