Further to the various policies implemented by Indonesian government related to the exportation of Crude Palm Oil (“CPO”), the Ministry of Finance (“M*F”) recently enacted the M*F Regulation No. 115/PMK.05/2022 to amend the calculation of Collection Tariff (Tarif Pungutan) to become USD 0 (zero) in order to reboot the exportation of CPO.

We are pleased to announce our recent success in representing offshore creditors – including an aircraft lessor – in the debt restructuring (PKPU) of Indonesia’s national flag carrier, PT Garuda Indonesia (Persero) Tbk. This restructuring – the composition plan of which has been ratified by the court on 27 May 2022 – has been regarded as one of the biggest in the history of PKPU, aggregating to a total debt of USD9.8 billion.

Our Restructuring and Insolvency Team involved in this case is led by Senior Partner, Tony Budidjaja and Senior Associate, Reynard Kristian.
Our sincere appreciation for the good cooperation of all the parties involved in the debt restructuring process.

We conveyed our utmost gratitude to the Legal and Foreign Cooperation Bureau of Directorate General of Sea Transportation (DGST) of the Indonesian Ministry of Transportation for the warm welcome during visitation by our Partner, Stefanny Oktaria Simorangkir along with Associates, Michael Pandjaitan and Fakhrana R. Fitria to the DGST’s office, on Tuesday, 28 June 2022. It was a valuable opportunity for us to be able to discuss various regulations and law enforcement issues related to shipping as well as their impact on the business practice.

During the visitation, our BIL’s Shipping & International Trades team had the opportunity to obtain an update regarding the Minister of Transportation Regulation on Arrest of Vessel’s drafting progress which has been pending since Quarter 1 of 2021. BIL reiterated the need to issue the foregoing implementing regulation considering the urge to provide certainty for stakeholders within the industry and mandate to regulate the matter pursuant to Law No. 17 of 2008 on Shipping.

Furthermore, BIL had the opportunity to raise the topic on the recent ratification of International Convention on wreck removal, i.e. Nairobi Convention and the Indonesian government’s homework to govern the related implementing regulations to smooth the implementation and implication of the said ratification.

We sincerely hope that our collaboration with the DGST will continue to thrive in the attempt to manifest our contribution to the development of Indonesian shipping laws and regulations.

Stefanny herself has handled numerous shipping disputes including cross-border commercial transactions disputes, marine incidents (collision, sinking, and fatality), cargo loss, and pollution claims dispute. She has also handled various non-contentious shipping matters including advising on sale and purchase of vessel, reflagging and registration of vessel, pilotage, affreightment contract, freight payment contract, and establishment of foreign investment shipping company.
