FAQ series: How important is it to have a Will (or Wills) in place?

Without a will, the law decides who inherits, not you. And the process will take a lot longer. A will puts you back in control and it's the difference between clarity and delay for your loved ones.

If you have assets in more than one country, you should think about setting up Wills in each of those jurisdictions. Do get in touch to arrange a consultation - we'd be happy to talk your particular case through with you.

What is an executor of my estate and how do I choose the right person?

This is a big discussion point with most of our clients and isn't always an easy decision.

Contrary to popular belief, your executor doesn't have to be a professional, nor do they need to be a lawyer or accountant. Arguably it is better to appoint a member of the family or close friend, but the most important factor here is that you trust your executor or executors.

Don't forget to check with your nominated executor(s) before you name them in your Will...!

Temporary Guardians

The question comes up a lot, so we thought we'd shed some light.

What happens if one of your appointed temporary guardians leaves the country?

If you have set up your Wills with us, we will have suggested that you nominate back-ups (and back-ups to the back-ups!) for exactly this reason. We recognise that Singapore and Hong Kong can be transient, particularly for the expats amongst us.

If you have several back-ups already listed, you may not need to amend your Wills or Guardianship Deeds. If you don't have many (or any) back-ups, please do contact us and we'd be happy to walk you through what is required so that you have peace of mind.

Back to school and time to dust off our instagram cobwebs!
 
We’re back from our summer trip, jet lag (finally) beaten and two of the children are back to school / nursery. The other is at home, covered in purees and dribble (hello the joys of teething and weaning)…as evidenced by the pictures.

I am excited to be using my brain again and being back at work after maternity leave. On one hand it’s the end of a chapter but on the other hand it’s the start of a new one. Time to lean into the work and family juggle that so many of us experience.

So whilst this is not an “I’M BACK” announcement…I am back. I look forward to reconnecting with friends, clients and contacts.

We will be posting about some key estate planning topics and FAQs so let us know if there’s anything in particular you’d like to read about. We’re back doing talks and webinars so if you’d like to arrange something at your school, workplace, club, parent group, do give us a shout. We’d be happy to collaborate and share some tips on what to think about when it comes to setting up Wills and Guardianship, particularly when you live overseas or you have more than one country to consider.

Appointment of a Living Guardian and Medical Proxy - what is this?

We are being asked a lot of questions on this at the moment, and rightly so. It’s a really important document to put in place and is so often overlooked.

This is where you appoint someone who can make medical decisions on behalf of your children if you are unable to, due to incapacity or unavailability.

This isn’t covered in the regular appointment of legal guardians (which only kicks in if both parents have passed away).
