Serves in Singapore

For those of you offering international process serves, you might want to update your websites in respect of Singapore.

In the middle of 2023, Singapore announced it was intending to become part of the Hague Convention on Serving – and on 1st DEC 2023, Singapore became a fully fledged Hague Convention state.

Formal serves are now through the Central Authority and Informal Serves are marked as “Not Applicable”.

🔻Off Duty Police Officers Serving Documents

For instance, one company claims that in Hong Kong its serves are carried out by off duty police officers. I was in the Hong Kong Police force for almost 36 years – and I never saw or heard of this. It was always very difficult to get permission from the top to take on ‘outside work’. If an officer did do process serving without appropriate permission and was caught, he would be in serious trouble, and would likely to lose his job.

Another company lists its charges and then adds on USD165 as a “government fee”. In the Hague Convention it states: “Hong Kong does not impose any fee for executing requests under the Convention”.

And finally, one that really made me smile. A company quotes from the “HONGKONG CODE OF CIVIL PROCEDURE ORDINANCE.” Unfortunately, the website publishers did not look into what they were publishing. What they have published is the “Code of Civil Procedure. No. 13 of 1873”. So, just on 120 years out of date! It also appears that OCR software was used to scan it as there are numerous mistakes throughout.

Hong Kong Process Serves – Overseas Process Serves

Samoa – Here we come!

Whilst the vast majority of the documents we serve are served in Hong Kong, we do sometimes get asked if we can serve overseas. We do, and quite frequently. We work with well tried and tested servers based in major cities around the world.

We have been asked to serve in the Cook Islands – we were all set to go when the client said not to proceed. We have served in Sweden, Japan, UK, South Africa, Malaysia, Singapore, the Philippines, Macau, and several other interesting places.

We have just completed a complex serve in Samoa – two companies served at the same address. The documents were from Hong Kong’s High Court and so the originals were couriered out to our associates in Samoa.

Some countries do not allow private or informal serves – such as China. China requires strict adherence to the Hague Convention for formal serves, including the formal translation into Chinese. However, if you are happy to have the documents delivered by hand to your target, let us know. We have successfully delivered documents for clients in several major Chinese cities.

On New Year's Eve, one of our younger process servers went out to serve a partially sighted 80-year old here in Hong Kong. No one was at home, so as per our client instructions, she called the guy on his mobile.
The string of foul language she received was incredible. She was told precisely where to stick the papers on her mother's body and was informed that if caught something would happen to her a thousand times over.
A follow up call was treated in much the same way.
We are looking forward to serving this "gentleman".
During the years that we have been serving documents in Hong Kong, I think this is the first time that one of our servers has been treated this way. There is just no excuse for this.

Gradual Border Re-opening

This story from the Hong Kong Standard is the best bit of news from Hong Kong in a long time…

The closure of the border between Hong Kong and China (and Macau) badly affected our process serving business, and to a lesser extent, the investigations side of it. While we never had great numbers of serves in Macau, we did have quite a few in China, especially in Shenzhen, and have been missing them!

The re-opening of the border cannot come too quickly. Great news.

'You've Been Served': Candidate Interrupted During Debate as Investigator Tosses Him Legal Papers

Veriton Asia has had some unusual seves, but this one in California really tickled me. Can't stop smirking!

A California gubernatorial debate was briefly interrupted on Tuesday when one of the candidates — while introducing himself to the audience — was served with legal papers by a private investigator.

Republican John Cox is among the 46 candidates running to replace Democratic Gov. Gavin Newsom in a September recall election. Cox was one of three of those politicians to take part in a debate held Tuesday night at Sacramento's Guild Theater.

The Los Angeles Times reports that the debate briefly devolved into spectacle when the private investigator advanced toward the stage, yelled, "John Cox, you've been served," and threw court documents onto the stage before being asked to leave.

According to The Sacramento Bee, the papers delivered to Cox allege that he owes thousands of dollars, plus interest, to a a Virginia-based consulting firm that worked on his 2018 campaign for California governor. Another good honest politician!

Repeating Serves Due to Mistakes in Paperwork

I love it when lawyers make mistakes and we have to re-serve. A UK High Court case about 5 years ago - urgent serve required. We did the serve immediately. Informed the client. Happy client. He called back a few hours later to admit they had the wrong case number on every page - and that we had to serve again. We charged him the full amount again.

A couple of days ago, we received from Canadian lawyers, a set of divorce papers that made reference, on the front page, to a specific date on which something had happened. We read the papers and found that there was a contracdicting date elsewhere in the papers.

This time we informed the client but did not charge as we had yet to do anything - but another very happy client!

How come these high paid lawyers don't check the work leaving their offices? Long may it last!😀

HongKongProcessServe is receiving more and more requests for Process Serves outside Hong Kong. Until the beginning of this year, the great majority of our serves were carried out in Hong Kong, with a few in China, the odd one in Macau and a couple in Singapore. However, in the past couple of months we have received requests for serves in Germany, China (Shanghai and Shenzhen), Canada (ON), USA (MA, NJ), Japan, Mauritius, and Singapore. Interestingly, most of the clients asking for these outside Hong Kong serves, are from within Hong Kong's legal fraternity. Late Payment of Fees by LARGE Law Firms to SMEs.

In mid-June this year, at VERY short notice, our company undertook work here in Hong Kong for a very large legal firm in Sydney, Australia. In view of the nature of the work (3 x process serves, one to be completed before end of same business day and two the next day), we asked for payment the same day (standard for process serves).
We usually get paid within 48 hrs, at most, for process serves. Client was happy that we completed the work as requested.
The sum is not huge. However,
the client has yet to pay, despite several reminders.
On being contacted to ask for payment, we were told that its client had not yet paid them, so they could not pay us. They said they understood the frustration!
I do not think they understand the anger this causes.
What about our cash flow, wages, operational planning etc? Our contractual agreement was not with their client but with them. Perhaps their client has not been paid by its client, and so on...
I have today made a formal complaint to the company.
Whilst waiting for a response, I am not holding my breath.
I note there have been attempts to introduce Late Payment Legislation in Australia: Does anyone know if it ever became law, and if so, does it apply to overseas sub-contractors?
