The Ministry of Immigration and Asylum set up a special department for issuing residence permits to investors of Third Country Citizens, thus ensuring the speed and immediate service of investors.

This is another move to strengthen investment in our country by offering flexibility and autonomy in new investments. A special department to treat investor applications was long requested, in order to ensure fast service and speedy issuance of residence permits. And now this became reality.

Therefore, third-country nationals as well as their family members who wish to apply through their attorneys for a five-year investor residence permit, also known as the Golden Visa, will be served by the new Investor Residence Permit Office located in the building of the Ministry of Immigration & Asylum (on 196-198 Thivon Avenue, Agios Ioannis Rentis-Nikaia).

Today this department opened its doors and has started accepting applications from the following categories:
A) for investment activity with time bank deposit, based on the provisions of article 16 of Law 4251/2014.
B) owners of real estate in Greece, based on the provisions of article 20B of Law 4251/2014.

Taking advantage of the Law 4764/23.12.2020, we put for the first time this law in practice, by successfully applying for a Golden Visa without a prior entry stamp on our client’s passport.
The newly enforced legal provisions are therefore effective and are apparently very attractive to all investors (especially the real estate owners), as entering Greece is no longer a requirement in order to apply for a Golden Visa.
The only requirement therefore is to sign a Power of Attorney at the closest Greek Embassy!

Independent right of minors to become investors and holders of a Golden Visa pursuant to an opinion issued by the Greek Legal Council of State

What was the problem?

Under the previous regime, it was not clear whether minors could obtain an investor residence permit. Especially as regards investor residence permits granted with the purchase of real estate, the minor relatives of the investor (descendants) could benefit from residence permits granted to their parents pursuant to the latter’s investment activity, as dependent family members, up until the age of 21, with the possibility of extension up to the age of 24.

After the age of 24, the investor's child had the following options:
(a) to resort to the solution of a different type of residence permit;
(b) to make a new investment in order to apply for an investor residence permit (Golden Visa);
(c) to pursue the acquisition of citizenship (provided that special conditions were met);
(d) to lose his/her residence permit and the rights deriving therefrom
The problem with the Golden Visa program arose when a number of previously submitted applications were rejected by the relevant Aliens and Immigration Directorates.

How was the problem solved?

In December 2020, the Greek Ministry of Immigration finally approved an opinion issued by the Greek Legal Council of State, which ruled that minors can also apply for and obtain an investor residence permit.

What applies now?

Therefore, minors can obtain their own Tax Registration Number and bank account, they can acquire real estate in their name and make other investments, and if the other conditions of Articles 16 and 20 of Law 4251/2014 are met, they can apply, as main applicants-investors, for an investor residence permit known as a "Golden Visa".

What are the additional benefits for investors?

An investor residence permit also benefits the investor’s family members (ascendants or descendants), therefore the applicant's parents can in turn apply for a residence permit as family members. This right is also reserved for the investor's children and his/her spouse in the future.

This decision underlines Greece’s intention to continue to offer the world's most successful residence by investment program. It also expresses respect for the family ties of foreigners who wish to invest and live in our country, cultivating a sense of security, while at the same time stimulating investment.

RESIDENCE PERMIT APPLICATION WITHOUT PRIOR ENTRANCE IN GREECE

Pursuant to Greek law No 4764/23.12.2020 a prior entrance in Greece is no longer a requirement to apply for Golden Visa. Investors (especially real estate owners) and their family members wishing to obtain an investor residence permit card can now, represented by their attorney, apply for a residence permit, without having an entry stamp on their passport and consequently without having entered the country. Applicants need to sign a Power of Attorney (PoA) for this reason at the closest Greek embassy. This condition is considered both necessary and convenient due to the pandemic. According to the same law, the applicants need to enter into Greece within 12 months from the application date, in order to submit their fingerprints.

Also, the deadlines for residence permit and their renewals in Greece are extremely strict and in order to facilitate the authorities that serve them but also to avoid overcrowding, it was decided to extend the dates accordingly:

1. Residence permits and blue papers that have expired from 01-01-2020 until 31-07-2020 are extended until 31-03-2021.

2. Residence permits and blue papers with an expiration date from 01-08-2020 until 31-03-2021 are extended for the additional time of 8 months starting from their expiration date.
