He also oversees our Criminal Defence work & will direct you to one of our Barristers, Solicitors, Paralegals or Police Station Representatives who operate across North Wales & Staffordshire. Simon has a wealth of experience and expertise in Immigration law and as our Crown Court department Clerk. Simon previously worked for a Legal Aid Solicitors in Cardiff where he established a reputation and following for his dedication to helping clients. He previously spent nearly 6 years working at the Home Office gaining invaluable experience in all aspects of immigration, asylum and nationality law. Simon then went on to qualify as a Senior Caseworker accredited by the Law Society of England and Wales. Simon was raised in Stafford and returned to the area from South Wales in 2013 to join the family business and establish the Immigration department of Eastgate Chambers. After relocating to Wrexham, North Wales in 2014, Simon opened a new office in Wrexham in 2018 to deliver a Legal Aid contract for Asylum & Immigration advice for the whole of North Wales. From 1st October 2022 our Legal Aid service for Criminal Defence work now extends to North Wales. Simon can deal with a diversity of Immigration matters from Entry Clearance applications to Higher appeals. An experienced advocate, he regularly appears before the First and Upper Tier Tribunals where he has secured leave to remain for refugees, helped to reunite families from overseas in entry clearance appeals and successfully defended clients against deportation from the United Kingdom. Simon has established relationships with a number of organisations that support people in this sector including Citizens Advice, the Red Cross, Rainbow Migration, the Welsh Refugee Council, Welsh local authorities, domestic violence organisations BAWSO, DASU & GORWEL and Cheshire Halton & Warrington Race & Equality Centre. Simon can be instructed as an agent for other solicitors to represent their clients at Immigration and Asylum Tribunal appeal hearings across the UK. For businesses, Simon can arrange Sponsor Licences and Tier 2 Visas for your employees. Appointments are available at any of our 3 offices or remotely by Zoom/Teams. If you are based overseas we deliver a VAT free service to you 100% remotely, with previous clients from as far afield as China, Russia, the Middle East and the US for example - we were using Skype video meetings a decade ago - long before remote working became the norm!

*update to below at 17:30hrs on 09/12/24*
- HOME OFFICE SUSPENDS DECISION MAKING ON ASYLUM CLAIMS FROM SYRIAN NATIONALS
- Following the fall of the Assad regime in Syria many Syrians in the UK will currently be celebrating but also some may be worried about what this now means for their right to remain in the UK.
- We are waiting for updated guidance from the Home Office & advice from ILPA. It is too early to say what changes the Home Office will make.
- If you have Refugee Status & are applying for Settlement the existing guidance is in the photo. You may still be considered to be at risk in Syria during this uncertain time.
- As there is no Government in Syria the Home Office continues to not have any agreement to return Syrian nationals.
- If you have claimed Asylum in the UK & are waiting for an interview or a decision we do not know yet if there will be a pause in decision making. Because of the uncertainty of the situation in Syria you may have an additional reason for claiming Asylum in the UK
- Home Office Country Guidance continues to state "the general humanitarian situation in Syria is so severe that there are substantial grounds for believing that there is a real risk of serious harm because conditions amount to torture or inhuman or degrading treatment as defined in paragraphs 339C & 339CA(iii) of the Immigration Rules/Article 3 of the European Convention on Human Rights"
- We do not anticipate this guidance changing immediately but it could be withdraw at any time if the humanitarian situation in Syria improves but it is widely believed that this may take some time to happen until free & fair democratic elections have been held, there is a new Government in power & a response from the international community to the need for aid/humanitarian assistance.
- In due course there will be a new country guidance Case Law to replace the assessment in KB (2012) that found "in the context of the extremely high level of human rights abuses currently occuring in Syria, a regime that appears increasingly concerned to crush any sign of resistance, it is likely that a failed asylum seeker or forced returnee would, in general, on arrival face a real risk of arrest and dentention and of serious mistreatment... that is sufficient to qualify for refugee protection".
- If you already hold Refugee Status or have obtained Settlement your status is unchanged.
- If you are now considering returning to Syria & you have not been granted Settlement yet, you are free to do so but you will most likely not be granted Settlement in the UK.
- If you are waiting for a decision on your Asylum claim & now want to withdraw your claim & apply for Voluntary Return to Syria, please contact us if you are an existing client, if not your Immigration Lawyer or the Home Office
- We will provide further updates as we learn of any developments/changes from the Home Office.
