Q: What are Lasting Powers of Attorney?
A: Lasting Powers of Attorney give someone, that you know and trust (an 'Attorney'), the authority to make decisions on your behalf.
Q: What decisions can be made by my Attorney?
A: The persons/people that you choose as your Attorney(s) can make decisions about a range of things within two categories: Property & Financial affairs; and, Health and Welfare.
Q: What specific decisions can my Attorney make about my Property and Financial affairs?
A: They can manage all of your dues and demands, such as rent/mortgage payments, utility bills. They can manage your money and assets; by looking after your bank accounts, any property you own, pensions, shares and investments. Also, they can buy anything that you need on a daily basis and even buy Christmas and Birthday presents for your friends and family.
Q: What specific decisions can my Attorney make about Health and Welfare?
A: They can decide what healthcare you should receive when you are ill and whether or not you should have life-sustaining treatment. If you have to go into full-time care, they can decide where is best for you to go, based on your needs and preferences. Even decisions regarding your to day-to-day routine, dietary requirements, personal hygiene and laundry can be made by your Attorney(s).
Q: Is it essential for me to make a Lasting Power of Attorney?
A: You can choose not to have one but this puts you in a very difficult position. Once you lose mental capacity, you will also lose the ability to make important decisions for yourself. In terms of health and welfare, the local authority will make decisions about where you should live and what care you should receive.
Sadly, if you don't have Lasting Power of Attorney in place when you lose capacity, you will not be able to choose who makes decisions for you. The Court of Protection will have to appoint a deputy and it could be someone that you don't know and/or someone that you would not have chosen.
Q: How do I make a Lasting Power of Attorney?
A: We would always recommend that you speak to a legal professional regarding anything to do with Wills or Lasting Powers of Attorney. There are many complex issues surrounding this area of law and you could end up with something that doesn't work the way that it should.
