Having a Will is an important part of estate planning, but does it cover everything?

Your Will takes effect after your death. A Lasting Power of Attorney is designed for your lifetime and allows you to choose who can make certain decisions for you if you lose the mental capacity to make them yourself.

Without an LPA, your spouse or children do not automatically have the authority to step in. Depending on the circumstances, you may need to apply to the Court of Protection to appoint a deputy.

Rather than choosing between a Will and an LPA, think of them as two different parts of planning ahead.

Problems between executors and beneficiaries can become highly personal, but a strained relationship alone does not necessarily mean an executor should be removed.

If concerns cannot be resolved informally, you may be able to apply to the court. The procedure depends partly on whether the Court has already granted Probate, and the court will look closely at whether removal is genuinely necessary for the proper administration of the estate.

It is equally important to understand the position if you are the executor facing a challenge. Not every complaint results in removal, and some disputes can be addressed through better communication, clearer accounts or professional guidance.

What happens when separated parents simply cannot agree about where their child should go to school? 📚

If the parents cannot agree, the court may issue orders to resolve or prevent a specific decision.

🔹A Specific Issue Order allows the court to decide a specific question, such as which school a child should attend.

🔹A Prohibited Steps Order works differently. It can prevent a parent from taking a particular step, including changing a child's school or relocating them to another part of the country or abroad without permission.

When deciding what should happen, the court will focus on the child's best interests, taking into account factors such as their needs, relationships, circumstances and, where appropriate, their views.
