A direct inheritance might disqualify them from benefits they rely on, be mismanaged due to a lack of capacity, or be vulnerable to financial exploitation by others. This is where protective trusts become essential.

Protective trusts can:

• Ensure funds are managed responsibly on behalf of the beneficiary
• Protect means-tested benefits eligibility
• Provide ongoing support without giving direct access to large sums
• Safeguard assets from potential exploitation or poor financial decisions
• Give trustees discretion to provide for changing needs over time

Trusts can be set up within your Will (testamentary trusts) or during your lifetime, depending on your circumstances. The trustees you appoint will manage the assets and make distributions in accordance with the terms you set out, always acting in the beneficiary's best interests.

You can't challenge a Will simply because you disagree with it. Only certain people can contest a Will, and they must have valid legal grounds.

The eight grounds include:

🔹Lack of valid ex*****on
🔹Lack of testamentary capacity
🔹Undue influence or coercion
🔹Lack of knowledge and approval
🔹Fraudulent circumstances
🔹Rectification or professional negligence
🔹Inadequate financial provision
🔹Proprietary estoppel.

Proving whether any of these circumstances occurred can be difficult, and time limits may apply depending on the type of claim.

These are two distinct stages in the conveyancing process, and understanding the difference is essential when buying or selling property.

The exchange of contracts marks the point at which a conveyancing transaction becomes legally binding. Contracts are exchanged between the buyer's and seller's solicitors, and a deposit (usually 10% of the purchase price) is transferred from the buyer to the seller. Once contracts are exchanged, both parties are legally committed to the transaction. If either party pulls out after the exchange, they face significant financial penalties.

Completion usually takes place a few weeks later and marks the property's official change of ownership. On completion day, the remaining balance of the purchase price is transferred, keys are handed over, and you can move in. This is the day you become the legal owner of the property.

The gap between exchange and completion gives both parties time to finalise arrangements, organise removals, and ensure all funds are in place. In some cases, exchange and completion can happen on the same day, though this is less common and requires careful coordination.
