Your employer has handed you a settlement agreement. Maybe it came out of nowhere. Maybe you half-expected it. Either way, you're probably asking: is this fair? Should I just sign it?

Here's the thing most people don't realise — you don't have to accept the first offer. Settlement agreements are negotiable, and the terms your employer opens with are rarely the best they can do.

Before you put pen to paper, there are a few things worth understanding:

✔ You're legally entitled to independent legal advice before signing — and your employer should contribute to that cost.
✔ Signing waives your right to bring future employment claims, so the terms need to be right for you.
✔ Enhanced redundancy pay, garden leave, reference wording, and confidentiality clauses can all be negotiated.
