On a recent community talk we did, a gentleman in attendance was adamant that he could sign his home away to his adult children, and provided this was done 7 years beforehand, his home would be safe from care fees.

Sadly this is a very common belief, but it is also a complete myth.
Where a Local Authority believes "deliberate deprivation of assets" has occurred, they can go back as far as they like, not just "7 years". ANY past disposal of assets can be considered as possible deprivation.

That is not to say that a family home (or other assets for that matter) cannot be protected, either in part or in whole. Do you know what your estate is worth?!
Do you know what the allowances are for Inheritance Tax, and how to qualify for them?

This week we have saved a client from paying an extra £70,000 in Inheritance Tax. The way he wanted to distribute his estate would have resulted in him losing his Residence Nil-Rate Band, but with just a slight adjustment, we have made sure he still qualifies for his £175,000 Residence Nil-Rate Band.

Busy working on production today.
In the photo we have on the left a standard Will; in the middle is a Will with Letter of Wishes; and on the right is a Will, Letter of Wishes, an Advance Directive, and 3x LPA's for one of our clients who is a business owner and has wisely opted to take out a Business LPA to complement the usual Property & Financial Affairs and Health & Welfare Lasting Power of Attorney documents.

Having trained under Craig Ward, Baron of Lundie, and studied his text book on Lasting Powers of Attorney; passed an entrance exam to the Society of Will Writers; and undergoing Continuous Professional Development every month; I'd say we're reasonably well qualified to advise on Lasting Powers of Attorney.

Or, you can just do them yourself... Powerful legal documents, done yourself... With no prior training or knowledge of the subject... What could possibly go wrong?!
