MYTH OR FACT?

So, this question is about whether your spouse will inherit your assets on death if you have not made your will.

In respect of assets and property held in your own name then the answer to this is both “Myth” and “Fact” and which depends on whether you have children or not. Either way without a will in place you rely on the law to say what happens to your assets when you die.

If you leave a spouse and you do not have children then FACT the law provides that assets that you own in your sole name will pass to your spouse.

If, however, you leave a spouse and children, and your estate is above £322,000 then the answer is “ Myth” your spouse does not automatically inherit everything. Instead, the entitlement is as follows:

• Your personal items to your spouse.
• A legacy of £322000 to your spouse
• If your estate exceeds £322000 the amount above £322000 is split into two equal shares and your spouse receives one of the shares so half of the sum about £322000. The other half goes to your children.

If you're buying a property with someone else, one of the key decisions you'll need to make is how you will own it. The two most common options are Joint Tenants and Tenants in Common.

Holding a property as beneficial joint tenants means you both own the whole property together, with no defined shares. If one owner passes away, their interest in the property automatically passes to the surviving owner. This is known as the right of survivorship.

Holding a property as tenants in common means each owner has a distinct share in the property, which can be equal or unequal. If one owner passes away, their share forms part of their estate and can be left in accordance with their Will.

The right option will depend on your individual circumstances. Factors such as how much each person is contributing to a purchase, future plans, family set up and estate planning should all be considered before making a decision.

Discussing your options with a solicitor at an early stage can help ensure your ownership reflects your intentions and provides the right level of protection for everyone involved.
