Today we are working in London in the First-tier Tribunal (social entitlement chamber) representing multiple appellants in housing benefit appeals.

The issue in dispute is whether their housing benefit claims qualify as exempt accommodation.

The appellants are being represented by Liam Bradley.

This week we have been working in Middlesbrough in the First-tier Tribunal alongside counsel at hearings involving appeals brought against refusals to pay housing benefit.

The appellants are residents of a national Charity and Registered Provider of Social Housing.

The main issue concerns whether the liabilities were created to take improper advantage of the housing benefit scheme.

In one of the appeals an additional issue in dispute was whether the support and supervision provided by the landlord in a supported housing scheme was more than ‘de minimis’.

LB Legal Representation instructed Jonathan Manning of 4-5 Gray’s Inn Square.

The hearings have concluded and the Tribunal has indicated that it may take up to 6 weeks for a decision and statement of reasons to be provided.

We’re pleased to report that the appeals for all 5 of our clients, which were heard by the First-tier Tribunal in Norwich on 21 and 22 August, were all allowed.

The Tribunal agreed that the appellants’ landlord provided them with more than minimal support.

This means that their housing benefit claims are to be treated under the exempt accommodation provisions and so their eligible rents and services charges can be met at an enhanced level instead of being restricted to the local housing allowance level.

The appellants were all vulnerable individuals with disabilities and complex needs.

The issue is whether the housing management provided by the appellant’s landlord amounts to support and therefore enables the housing benefit claim to be treated as exempt accommodation.

Today we represented a gentleman in an appeal against the housing benefit decision of the local authority at the first-tier tribunal in Manchester.

The appeal concerned whether our client received support and supervision from their landlord at a more than minimal level within a supported housing scheme for vulnerable individuals.

The decision was handed down shortly after the hearing and the appeal was successful.

We are of course delighted for our client.
