A recent Women’s Aid survey has highlighted the fear and uncertainty experienced by survivors of domestic abuse as prisoners are released early under the Government’s early release scheme.

For someone who has experienced domestic abuse, the release of an abusive former partner can be deeply unsettling. Concerns about whether they will be informed, what support will be available and how their safety will be protected can be incredibly difficult to navigate.

Domestic abuse can affect anyone, and all survivors may experience similar fears and uncertainty when faced with the potential release of an abusive former partner.

The impact of domestic abuse does not necessarily end when a relationship ends or when a criminal sentence is imposed. For some survivors, separation can be the point at which new concerns around safety, contact and ongoing abuse emerge.

This is why effective communication between the criminal justice system and survivors is so important, alongside appropriate safeguarding and support.

As family lawyers, we regularly see how domestic abuse can continue to affect families after separation. The safety and wellbeing of survivors and their children must remain central to any decisions that affect them.

At LGFL, we believe abuse does not discriminate. Men can be victims too, and we support all survivors of domestic abuse.

Technology can make our lives easier, but in the context of an abusive relationship, it can also become another way to exert control.

A recent Australian case highlights how technology connected to everyday life can be misused as part of a wider pattern of domestic abuse. In the case, technology linked to a former partner’s vehicle was allegedly used to alarm, monitor and restrict her after the relationship had ended.

It is a reminder that coercive control does not necessarily end when a relationship does.

From shared accounts and passwords to location tracking, smart devices and connected cars, technology can create new opportunities for controlling behaviour to continue after separation.

Recognising these behaviours as part of a wider pattern of abuse is important.

What does the latest Child Focused Court decision mean for families?

The Child Focused Court (CFC) model was introduced with the aim of keeping children at the heart of family court proceedings.

The first case to progress through the CFC model has now reached the Court of Appeal, which has partly allowed the appeal.

Importantly, the judgment highlighted that the CFC model does not change the underlying legal framework. Instead, it is about how cases are managed and how the court keeps the needs and experiences of children at the centre of proceedings.

As this approach continues to develop, decisions like this will be important in showing how the Child Focused Court works in practice and what it means for families going through proceedings.
