A pre-nuptial agreement can play a significant role in a high-value divorce - but careful drafting matters.

A recent High Court case involved a couple with substantial assets and a pre-nuptial agreement signed around seven weeks before their marriage.

During the proceedings, the court found that the wife had removed the signed copy of the agreement and had initially denied its existence. Despite this, the court found that the agreement had been signed and broadly enforced its terms.

The wife received around £4 million in total provision, while the husband retained approximately £23.8 million in assets, alongside significant pension wealth.

The case is a useful reminder that a pre-nuptial agreement is not simply about signing a document. Clear drafting, appropriate advice and careful consideration of future circumstances can all be crucial.

For couples with significant assets, obtaining specialist family law advice before marriage can help provide greater clarity about financial arrangements should the relationship break down.

Are legally binding pre-nuptial agreements on the way?

Pre-nuptial agreements are becoming increasingly common, but in England and Wales they are not currently legally binding.

That could change.

The Government has been consulting on proposals to introduce “qualifying nuptial agreements”, which could give couples greater certainty over how their finances would be dealt with if they were to separate - while retaining important safeguards around issues such as coercion, independent legal advice and meeting children’s needs.

So, what could the proposed changes mean for couples planning to marry or enter into a civil partnership?

A new government consultation is considering whether cohabiting couples should have greater legal and financial protection when a relationship ends.

Proposals include potential lump-sum payments following separation, new inheritance rights and stronger financial protections for survivors of domestic abuse.

Eligibility could depend on factors such as having a child together or living together for at least three years.

These are proposals currently under consultation, not changes to the law.
