⚖️ A BIG CHANGE IN FAMILY LAW – WHAT PARENTS NEED TO KNOW ❤️

There has been a significant development in family law that parents should be aware of.

Since 2014, the law has started from the presumption that a child benefits from both parents being involved in their life, unless evidence shows otherwise.

On Tuesday night, MPs voted 301 to 193 to remove this presumption, in a move campaigners have called “Jack and Paul’s Law.”

💬 But what does this mean for parents?

The change aims to put children’s safety and wellbeing at the heart of decisions about family arrangements, particularly where there are concerns about domestic abuse or harmful behaviour.

It is important to understand that this vote does not mean that one parent will automatically receive more time with their child, or that the other parent will lose contact.

👨‍👩‍👧‍👦 Every family is different. Every child’s circumstances matter. And decisions about children should always focus on their individual needs, safety and best interests.

📌 What happens next?

The Bill still needs to pass through the House of Lords before the law can change. For now, the current legal position remains in place.

You'll receive structured training covering areas such as:

Whether you are a fully fledged McKenzie Friend, have experience of legal administration or support, been a Paralegal, worked within a advocacy or support role - navigating complex processes or have professional experience supporting vulnerable people...we'd love to hear from you.

As part of our small team, you will:

✔️ Provide practical and emotional support to clients
✔️ Assist clients with understanding court procedures, directions, deadlines and documentation
✔️ Attend meetings and court hearings with clients and provide support, where permitted
✔️ Take clear notes during hearings and help clients understand the directions and next steps.
✔️ Maintain confidentiality and handle sensitive personal and legal information professionally

👧 What is the new 'Child Focused Court'?

Cuts to legal aid mean that many parents are representing themselves. In around 80% of cases, at least one parent is a litigant in person.

This means cases can take much longer to resolve, often lasting years. The Child Focussed Court aims to tackle that issue.

Put simply, the Child Focussed Court wants to know more about the child - much earlier in the case.

Rather than the case being mainly about what Mum says and what Dad says, the court wants to understand:

❤️ How is the child doing?

🏠 What is life like for them?

🗣️ What are their wishes and feelings?

⚠️ Are there any worries about their safety or wellbeing?

👨‍👩‍👧 What arrangements would be best for them?

If you're a parent going through Family Court, understanding this change could help you prepare.

Being a Litigant in Person doesn't mean you have less of a voice. But you do need to make sure your voice is clear, organised and focused on your child.
