Legal Rights for Unmarried Couples: What You Need to Know 💡

Did you know that unmarried couples do not have the same legal rights as married couples, even if you’ve lived together for years?

Here are some key points to consider:

🏠 Property Ownership: If you own property together, how it’s divided in the event of separation depends on how it’s legally registered. A Cohabitation Agreement can help clarify ownership and financial arrangements.

💰 Finances: Unmarried partners do not automatically inherit each other’s estates unless named in a will. It’s essential to have proper estate planning in place to protect your partner.

👶 Children: Both parents have a legal obligation to provide for their children, but parental responsibility may need to be legally established for fathers not named on the birth certificate.

Protect your rights and plan ahead. At Tinsdills, we’re here to provide tailored legal advice and practical solutions for unmarried couples.

How important is a financial consent order and dealing with divorce finances? As it turns out, very important 🔑

With the new no-fault divorce laws, it is now easier than ever for parties to divorce. Applications have hit their highest level for over a decade. Lots of couples are opting to deal with divorce themselves.

The risk is that separating couples may not be seeking the legal advice that they once would have done when commencing divorce proceedings was less accessible.

A divorce alone does not deal with financial matters - Financial claims remain ongoing until former spouses have put in place what is known as a ‘Consent Order.’

Understanding Property Chains: What Are They and How Do They Work? 🌟

Entering the property market? Whether you’re buying or selling, you might encounter a "property chain." But what exactly is it?

What is a Property Chain? 🏡⛓️

A property chain is a sequence of linked property transactions. Each link in the chain involves a buyer and a seller. The chain starts with someone who is only buying (not selling), often referred to as a first-time buyer, and ends with someone who is only selling (not buying), often referred to as the end-of-chain seller.

How Does It Work? 🤔

Chain Formation: When you buy a home from someone who is also in the process of buying their new home, you become part of a chain. Your seller is waiting on their purchase, and your buyer is dependent on selling their home, and so forth.

Dependency: The success of your transaction depends not only on your immediate buyer or seller but also on the transactions at other links in the chain.

Completion: All sales and purchases in the chain typically complete on the same day. This means that everyone moves on the same day, making timing and coordination crucial.

At Tinsdills Solicitors, we’re here to help navigate and manage your property transactions, whether you're buying or selling, chained or chain-free.
